Is my solicitor at fault for not removing bankruptcy attached to my house from previous owner m?

I bought my house in 2008, I am now in the process of remortgaging in order to have my ex partner removed from the morgage deeds. The land registry has came back that in 2007 the previous owner had a bankruptcy attached to the title however I was not made aware of this and the sale of the house went through.
I cannot go any further with my remortgage untill my then solicitors have this lifted.
Should of my then solicitors had the bankruptcy lifted ? I have also been informed that my current morgage may not be leagally binding.
Many help advise would truly be appreciated.
Thanks guys

They should have made sure the seller's solicitors had the bankruptcy charge lifted.I have also been informed that my current morgage may not be leagally binding.
Well the charge may not be legally binding, it may be that it is only a second charge ie comes after the bankruptcy. At worst it would still be binding on you but may not be secured on the property.
The solicitors that handled your purchase should have sorted this out.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
