Any BR couples with an IPA?

Hi again all
It's me again worried to death..didn't sleep much last night worrying about the possibility of a hefty IPA! I'm due to start the job monday. OH seems to think that i should leave things and wait and see if our discharge comes in the next 3 weeks then report it if not or leave the job if it's not gonna leave me with any extra money at all! Just wondered if anyone had been in the same boat as us?? At least i feel i can get it off my chest on here. Thanks all.

Unfortunatly it is ultimatly up to you. You have to decide how much surplus you think you will have with a revised I&E that you will have when working and then look at the chart that was posted to see how much the OR would take. I guess it would all go in one pot as such and i would be contributing. Just been looking through my old bankruptcy petition and i don't understand how in both myself and OH's petition we both have the outgoings section filled in the same, even though i was not working. Would i have to put full outgoings down again on the IPA? Not sure how to split the outgoings? As a new worker what things could i put down for my expenses that would be acceptable? Does anyone know if there's a list of sorts somewhere that i could refer to with regards to outgoings limits? Also what's the difference between an income payments order and an an income payments agreement? or is it the same thing? Sorry if i seem to be ranting! lol!0

The IPOQ just asks for "outgoings". It doesn't state whether it is for the whole household or just you. Personally, I would just put down how much you contribute to each part of the expenditure and make sure that's clearly marked on the form or explained in a covering letter.
There's no definitive list, since to a very large degree it is up to the discretion of each OR. The best you can do is list what you think, and again we'll comment on what we think the OR will make of it.
Agreement is just that. It's an agreement that you voluntarily sign, and which is then legally binding.
If you refuse to sign and the OR believes it is justified they can apply to the court for an income payments order. If the court makes the order then you are bound by it. However you can make your case to the court when it is made, and if the judge thinks the OR is being unfair the may not grant it. Just read a lot (probably way too much:o) on forums like this and elsewhere. Think i'm going to take my chances and see if in the next 3 weeks i get an early discharge, if not then i'll inform the OR and take it from there. I guess it'll prob be about half of what i've earned perhaps and maybe there may be a little room to negotiate, either way i might still be a little better off, if not i suppose i can always leave. But this job is a golden opportunity for me with future prospects etc so i'd like to give it a go. I'll just have to look at it like a 36 month loan..and it's less time than an IVA which would be over 5 yrs. Just wondered if the OR counts the first £100 of my wages..thanks for your help, you've been brill!0

The OR will look at your I&E and allow you this from your wages. Then if you have more than another £100 left over from this he will then take a % of that surplus.
IE if you earnt £500 and your allowable I&E came to £450 then no IPA.

Hi,
I was just wondering as I have looked around the forum and could not the information I was looking for. My wife and I went bankrupt in April 2007. I start a job in June and therefore filled out an IPQ after 3 months of starting this job. My Wife is claim INCAP and DLA and has a Mobility Car under the used scheme (pay for the car for 3 years and it's yours to keep).
I would like to know if possible, whether they would exempt the DLA and INCAP from the SOA?
Any help would be most greatful!0 -
