Overpaid by Former Employer

I have been overpaid a considerable amount by my former employer on my final payslip. I contacted them to explain the overpayment, and have been phoning once a week for the last 4 months to try to get them to deal with the overpayment (presumably by taking the overpaid amount from me). Every week they say they will sort it but nothing ever gets done.
Even though they never do anything about it, I cannot simply move on and spend the money in case they decide to take it or chase me for it, and I do not like having this unusable money in my bank account. I think I have made a beyond reasonable attempt to get them to take the money back and I am really unsure of what to do. It is causing me stress to have this money in limbo in my bank account.
There is also an additional problem: I am not sure EXACTLY how much they overpaid me. The overpayment was all under 'holiday payment' for the holiday I did not take but was entitled to before I left the job. I am not sure how much holiday I was entitled to in total as I am unsure of exactly how it was calculated, and do not want them to take ALL my holiday payment away, since I am entitled to SOME (just not the entirety of enormous amount they paid me). Surely they should be more concerned about taking this money back, or tell me to keep it, rather than leaving me in limbo which is causing me anxiety.

I guess you need to work out how much holiday you didn't take?
Also bear in mind there was a EU thing which my old company followed last year. Apparently any overtime you do should accrue holiday, so a lot of companies rather chose to pay that as a one off payment at the end of financial year. It was quite a bit of money so it might be including that too.0 -
move what you think you owe them to a savings account.
If they ask for it back then you can send it back. This then removes the temptation to spend it
Remember they have 6 yrs they could possibly claim it in.
You have tried to make contact and have alerted them to it so I would now wait for them to get their act together.I am a Mortgage Adviser
