CCJ for my wife and I for the same debt

Hi all,

ok so basically, my wife and i have received a CCJ on our files for the same debt. Is this possible ?

    The simple answer is yes - if the agreement that you defaulted on was in yours and your wife’s name.

    Yes, if you were "jointly and severally liable" for the debt. The contract under which the debt has been chased will have used this phrase.

    Is this the first time you and your wife became aware of the CCJ (when you each/both checked your CRA files)?

    Did you (and your wife) receive the original claim form(s)?

    I ask in case there may be a need to attempt to get the CCJ(s) set-aside if they were incorrectly served so you didn’t get the opportunity to defend the claim.

    It was such a long time i can't honestly remember. and we'd moved from the address they sent it to.

    Basically we were forced to leave our house as i left the job we received the house for and with no where to go to council made us pay for storage of our goods while they tried to make us stay in a b&b for weeks.
