Hey everyone,
I have received a letter from Lowell solicitors.
'We act for Lowell Portfolio Ltd and we are instructed to recover your debt of 354.82 pounds.
On 01/04/2014 you entered into an agreement with BT PLC to provide you with a BT PLC account. You failed to make payment in accordance with the terms of the agreement and it was later terminated and subsequently assigned to our Client on 15/09/2017. Notice of the assignment has previously been given to you and you may request a copy of the agreement on the enclosed Reply form.'
...
...
If you fail to make payment or respond to this letter as set out in the enclosed documents within 30 days of the date of this letter (15/12/18) we will issue a County Court Claim.'
I have never received anything like this before so I am unsure of what to do.
I remember briefly that I cancelled the subscription however then went back with BT on another service and from what I recall this was all sorted on the phone. Now I have actually been living in Spain for the last 2 years and now that I return I have found this letter at my dads house, which I have never been registered at, with this letter!
Does anybody have some advice for this?
Thank you very much!
Daniel

If you genuinely do not know what the debt is for, you should contact Lowell and find out more information. They should be able to give you some basic information about the account in question.
If this corresponds to the issue that you believe was resolved with BT, then you should contact BT and ask them to confirm this to Lowell. You should ask BT to also send this confirmation in writing to you separately so you can also independently send this to Lowell.
If the debt is genuine, I would recommend either getting in contact with Lowell and paying the full amount so the matter ends there. If you cannot pay the full amount, Lowell should help you set up an affordable payment plan according to your income and expenditure - this will also be the end of the matter (unless you don’t keep up with the payment plan you agreed).
As it states in their letter, they will only take the matter to the county court if you ignore the letter and bury your head in the sand so take action now.0 -

You have received a Letter Before Claim which gives you the opportunity to raise a dispute with the debt before they can, or should, issue a claim 30 days later.
They say you can request a copy of the BT agreement on the Reply Form.
You could either Tick Box D stating you dispute the debt because the account was paid, and then go to Box I to ask for documents including the BT agreement and Notice of Assignment which Lowell believes was served on you (notwithstanding the fact you my have been living in Spain at the time).
Or you could tick Box C saying you want more time to seek advice.
Debt Camel has a good explanation of how to manage a Letter Before Claim here >
https://debtcamel.co.uk/letter-before-claim-ccj/
You can also send a Subject Access Request to BT to see what data they have on file about the account and the subsequent account. If BT haven't got the information then how will Lowell get it to prove their claim
