Put in to buy the council house received a letter saying it’s been refused and contacted the fraud officer as stated on the letter.
Been informed due to a housing benefit over payment which wasn’t our fault by the way our right to buy is refused. We can reapply once the over payment as been repaid.
Anyone advise if this is the correct information, not buying the house of the benefits department where buying from the council

Its common practice that if you have arrears your application will be declined untill they are cleared. At the end of the day they aren't going to hand over their asset if they are still owed money. Whats to say it will get paid at a later date? (As a generalisation not suggesting you wouldnt)
The benefits department is still part of the council. So looking at them as 2 seperate things is wrong. You owe the council the money as its their pot the money came from.
If your application was with a HA and you owed the council that would be different as 2 seperate things.0 -
They say we still owe 1900 on the overpayment we’ve been paying it of for the last few years.
Started off they sent us a letter from payslips so we sent them off like we always do.Weeks later we get a letter saying about the over payment,I rang up to find out out how we can possibly owe this when we keep them informed and was told they didn’t no about my wife’s 2nd job even tho I informed them.
Fast forward a few weeks I was to attend an interview under caution for fraud, now my wife was doing a few hours here and there while training ext so I admit was a few months later I informed them of her 2nd job as the job because permanent. With it only been odds days and odd hours I didn’t think it mattered,so like I say soon as it became permanent I informed them.
So end of the day they claimed something like 2 years over payment I appealed it as I even produced a copy of the letter I sent to them informing them about the 2nd job.But like normal no matter what you do it’s never the benefits fault and lost my appeal sohave to pay back0 -

I would sort out paying the 1900 back to HB then !Advice given on Assured and Regulated Tenancy, Further advice should always be sought from a Solicitor....0 -
Perhaps slightly off topic and mostly just me being nosey...
How much is it to buy your council house?
As I understand it it is valued and you pay a heavily reduced amount of that value right? based on how many years you have lived there?
I also have a feeling it can be an issue to get a mortgage because many are not of standard construction.
Sorry its not a helpful post

Their mistake doesn't mean you get to keep money you weren't entitled to. It means you will usually get an extended period to repay it.I appealed it as I even produced a copy of the letter I sent to them informing them about the 2nd job.But like normal no matter what you do it’s never the benefits fault
As you now want something from them, it appears that repaying your overpayment a little faster is going to be necessary.I am a mortgage broker. Unless you have evidence to show you gave them that letter (signed delivery, email receipt, confirmation letter) there is no evidence they were ever told.
Just on a side note..... if you can't afford to pay it off how will you afford to maintain the home & mortgage if you buy it?
Do don't mention how much you pay back per month etc.
They won't budge on their point of view until you have a clean slate0 -

Not just me thinking this, then...sevenhills wrote: »If you can afford to buy your council house, surely you can afford to pay off the HB straight away?0
