OR Interview

Does anyone know how long after the interview we will hear about whether our car is exempt and if so will we lose it on value grounds?

OH needs a vehicle to actually work sodoes anyone know what the usual procedure is if they claim it on value grounds, are we going to be without a vehicle while they sell it and raise funds to give us money to buy a cheaper one?

Also daughter does afterschool club every wednesday and there is no direct bus route home , too far to walk, and it would be dark by the time she got home if we are expected to get her a taxi then our SOA will be different.
We love what we are doing and we love why we're doing it!!

IF the OR decides to 'sieze' your OH's car after he has proved that he needs a vehicle either for work, or for looking for work, the OR should provide him with sufficient cash to purchase a cheaper car that would be 'fit for the purpose'.

  • Hi,
I’m new to this site, had my OR interview last week. I had similar issues with the value of my car. The vehicle is worth approx £4000, OR will allow me £2000. The OR had a valuation done on the vehicle and gave me two choices. Either get a friend/family member to purchase the equity in the vehicle (£2000), or hand the car over to them to sell at auction, after which they would give me back any money over the £2000. As I need the car and would be really stuck without it I opted to raise the money through my family. OR was really unsympathetic and has given me just seven days to get the cash!

Thanks for info, when you say OR had a valuation done did you or OR have to take the car somewhere or was it just looking up the make or model on Parkers or somewhere?

Seems a shame that they don't knock off auction fees, collection costs etc which would be taken from the equity if they did auction it when they offer a friend or relative a chance to buy it. I doubt if it went to auction they would have £2000 left after fees etc to pay creditors.

Must stop myself speculating and just wait and see what happens i suppose, the trouble is i'm one of those people who like to have it all sussed out way ahead and with something like this its out of my hands. If all this worrying and speculating would solve it all well and good but i know it won't so what a waste of time:eek:

  • They used a local agent, i.e. the closest auctioneers. I was advised that it was dependent on the agent whether they come out to look at the car or assess its value over the phone. The agent came out to value mine.
You are right regarding auction/collection fees etc, I should imagine that there would be some room for negotiation. I am tempted to try that with my OR and see if she would settle with £1500, but she’s not the most helpful or nicest of people.
    Hope this helps!

Of ALL things in Bankruptcy - OR handling of 'vehicles' seems to be one of the most inconsistent.
