Skillstrain - Train2Game - Debt/CCJ

Hello,

Long story short - When I was a naive 17/18 year old fresh out of high school I joined an 'online course' Train2Game by Sillstrain without doing the research at £130 a month or something stupid. Wised up and thought screw this I'm not paying for this, didn't get what I was promised and I told them so. Think I paid for half of the £5000 course fee in the end before I told them to do one. Yes I signed a contract.

After that I didn't hear anything for like 6 or 7 years, literally nothing. All of a sudden a CCJ is on my door step asking for X amount, I'm like what the hell. I know I shouldn't have done but I swept it under the rug and forgot about it. It stayed on my credit report for a bit and then disappeared so I thought that must be the end of that. Another 2/3 years roll by, another CCJ, or the same one I'm not sure but this time It's stayed. Right before xmas I was slapped with a Notice of Application for Attachment of Earnings Order which threatened to put me away for 14 days if I didn't respond. I'm like surely not, I did actually mean to respond to this one but it was the week before xmas and thought I'll worry about it afterwards. Today I got another notice with a more intensive threat, which I have duly filled in and sent off today.

I'm in the final year of uni (I worked for a bit), unemployed since August, just finished a 14 month placement in Harrogate. The student finance I get is enough to see me though until graduation in June. My partner had to give up work to look after our 3 year old disabled son (9 weeks prem, Cerebral Palsy).

Do I have any leeway here at all? Obviously I cannot afford to pay anything back unless they want a fiver a month. Has anyone else had this kind of issue? Advice needed. Thanks

  • Do i read this right that you at the beginning of the period when you made no payments have no contact at all with them? in no way acknowledged the debt? and never made a payment?
    If so the the debt should have been statute barred

    If your not in work, they cannot obtain an attachment of earnings, as you have no employer.

    What exactly have you put on the form ?

    We also need more precise dates from you, as it sounds like this may of been statute barred before default judgement was granted, what year was the CCJ originally granted ?

    Nope didn't hear a thing and cancelled the direct debit. Didn't hear anything for a good 5/6 years. Couldn't put an exact date when a letter came though the door though.

    It said to just tick unemployed on the form. As above, I couldn't put a date on it unfortunately, is there a way I can find the date?. I remember it on my credit report then just disappearing and then re-appearing a year or so later.
  • Okay so I've just looked on my credit report. This current CCJ was put on me in July of 2017. All this time I've been thinking it was the original one. That explains why a CCJ disappeared and another one took its place. How is that possible?

    Can they issue two CCJs for the same debt.

    I definitely did not acknowledge the original CCJ - It must be Status Barred surely.

    Unfortunately, you won't be able to get a definitive answer with only vague dates.

    As I understand it, if they got the original CCJ within 6 years of you last acknowledging the debt, and if they applied to the court for further action less than 6 years after the original CCJ was awarded, it could still be legally enforceable.

    Have you tried contacting the court and asking for dates and details of the case?

    You can only be taken to court once for the same debt.

    If you ticked unemployed then that closes that chapter.

    It will depend how much more money the creditor wants to waste knowing your not currently working, I suspect they may quietly drop this now.

  • I never acknowledged the debt

    I've just done a check using Trust online going back through every address I've lived at. I signed up to the course in the house I grew up in 2009 and stopped in the second address I lived at 2010

    I definitely stopped paying over 8 years ago.

    There is zero evidence of the original CCJ. It's like it wasn't even issued, is that the same as it being Statue Barred? The only one is the current one which was issued July 2017.

    Once again, I phoned them to say I would not be paying anymore and never acknowledged any letters. After research (see first post) I didn't recognise there authority and ignored all letters asking for me to pay.

    Once legal action has been taken the limitations act no longer applies, you can only have one CCJ per account.

    CCJ’s never go statute barred.

    As I said, if your not working and you have no assets, then the creditor can do little else to enforce the judgement.
