As for the comment about a poor reference, in most situations you'd be right but my employer doesn't give references. Instead they just have a series of boxes to tick which basically verify that you were employed there. No matter how hard you work or how much success you achieve that's all you get when you leave.

I made it clear to my manager before Christmas that I was really struggling for money and that I couldn't afford to do less hours or take holiday in place of actual shifts. He was totally unsympathetic. Now it just feels like they're taking the mick.

The type of reference you mention is commonplace these days. It avoids the risk of any comeback if something is put into the reference with which the former employee disagrees.
What do you expect of your manager? They can't just give payrises, extra hours etc because a staff member isn't happy. They can, and should, insist that you take the minimum statutory holiday entitlement of 28 days including Bank Holidays. If they are allowing you to work those days, and that gives you extra money, it could be argued that they are doing you a favour though.
  • Is it not normal to be paid for Christmas Day if you have the day off by taking leave or having the bank holiday off?

You were paid, it was deducted from your paid leave allowance.

They're your employer;OK - this is fairly obvious not your friendsome might be, family memberOK?, counsellor again - irrelevantetc.

I'm not saying they're good employers. Are you saying they're bad ones? But you continue to work there, knowing all this. Because everyone can just turn up and get another job

The definition of insanity is doing the same thing over and over again, expecting a different outcome. Not a legal definition

The definition of insanity is posting the same holier than thou responses over and over again.
  • That's what the OP seems to have said. They seem surprised?

I'm hardly holier than thou. I don't expect to be treated differently to what I posted.

I might be, because I have a good employer. But then I have applied for the correct positions, done well at interview and continued to progress in my chosen field. - it didn't happen by pure luck.

My point about them not being friend, family etc is that there should be no expectation on an employer to take personal circumstances into account (with exceptions for disability etc of course).

No I'm not saying their a bad employer. I would put them in the distinctly neutral camp. They are abiding by their legal responsibility.

No I don't think anyone can just 'turn up and get another job', but given the OP argued about this same thing LAST YEAR, they've had 12 months to move on; and yes that is plenty of time for someone who is determined.

Nor did I claim it was the legal definition...
  • Yes, I do think you should be paid. But I also think you should try to moderate your anger - you come across as very angry. (I sympathise, because I am like this as well.) I think you will get a better result by counting that hour as one of the hours you have worked this week*, and including it on your hours worked sheet, taking an hour of in lieu in consultation with your manager, or whatever else you have to do to ensure that this is processed as a work hour.

*This does assume that you didn't go home shortly before another manager arrived and then arrive back at 9am. But even if you did, I think you can argue that you left the site to see if there was anyone you could contact (so you were still working, in that case!) and to keep warm as you had not dressed for an hour standing in the cold.

All the stuff about taking Christmas Day out of your holiday is irrelevant - the other posters on this thread are correct and of course it is taken out of your holiday.
