Yahoo! Travel Superbreak Competition Terms and Conditions

1. This prize draw is run by Yahoo! UK Limited, 125 Shaftesbury Avenue , London WC2H 8AD ("Yahoo!").
2. By entering the prize draw, you agree to these terms and conditions. Yahoo! will send confirmation of your entry into this prize draw and acceptance of these terms and conditions to the email address provided by you upon entry.
3. No purchase is necessary nor fee charged by Yahoo! in order to enter the prize draw, although entrants are responsible for all costs and expenses relating to the prize draw, such as the cost of accessing the Internet and any other costs and expenses associated with your participation in the prize draw and/or your claiming or enjoyment of the prize if you win.
4. You must be 18 or over and resident of the UK or Republic of Ireland to enter into this prize draw and to claim or participate in the prize if you win. Directors, officers and employees (or any of their immediate relatives) of Yahoo!, Superbreak Mini Holidays Ltd (“Superbreak”) or any of their group companies or other agencies associated with this promotion are not eligible to enter into this prize draw and to claim or participate in the prize. Entrants will be deemed be the natural person to whom the email address (provided on entry) is registered. Only one entry per person is permitted.
5. To be eligible, you must submit your application as detailed on the prize draw entry submission page: http://advision.webevents.yahoo.com/swisshotel . Entries must be received not later than 2359 hours GMT on 30th November 2007 after which the prize draw will close. Yahoo! is not responsible for telephone, network, electronic or computer failures or delays of any kind or for entries that are stolen, misdirected, incomplete, garbled, delayed, lost, late or damaged.
6. Yahoo! will select 1 winner from the complete entries on 1 st December 2007. Yahoo!'s decision is final and no correspondence will be entered into. If you win a prize, you agree to provide Yahoo! with all information reasonably requested by Yahoo! in order for Yahoo! to substantiate your identity, age and place of residence. The winners will be notified via email on or before the 31st December 2007.
7. The prizes are provided Superbreak Mini Holidays Ltd , 60 Piccadilly York , YO1 9WX and are as follows:
Ho tel accommodation at the 4* Swissotel Amsterdam, for two adults sharing a superior room on a bed and breakfast basis for two nights. The prize is accommodation only and does not include travel.
The prize will be delivered as a voucher, this would be valid for a 2 nights stay for guests arriving either on Friday or Sat. The voucher is valid for one year from 1st Dec 2007 . Reservation will be on request and subject to availability. Exclusive of New Year's Eve and Easter.
The prize is a package and must be accepted as a whole. The prize is not transferable or redeemable for cash (in whole or in part). Yahoo! and/or Superbreak reserve the right to amend the prize and/or award a substitute prize (or part thereof) of equivalent value if it is unable to provide the prize as stated above. The winner must also comply with Yahoo!'s, Superbreak's or any other third party supplier's instructions about the prize and any applicable terms and conditions.
8. Confirmation of whether or not you have won the prize will also be available on request from Yahoo! after 30th January 2008 by writing to Yahoo! at the address given above. Every reasonable effort will be made to contact the winner. If the winner cannot be contacted within one week of the prize draw, the prize will revert to Yahoo! and may be awarded to another entrant at Yahoo!'s discretion.
9. The prize will be delivered as a voucher in the name of the winner which will be sent via registered post or courier to the address provided by the winner. Yahoo! does not accept any responsibility for any failure or delay in any postal or courier system or the winners' failure to accept delivery of his/her prize.
10. Yahoo! may use information relating to the prize draw for marketing or promotional purposes, including use of the winner's name and likeness. Otherwise, personal information of entrants will always be used to conduct the prize draw, for participation in the prize and in accordance with Yahoo!'s Privacy Policy, currently located at http://privacy.yahoo.com/privacy/uk .
11. Except as otherwise required by applicable law, Yahoo! is not responsible for any loss or damage associated with you entering into these terms and conditions, this prize draw, the carrying out of the draw or the provision or otherwise of any aspect of any prize or any act or omission of any other person or party, and all warranties, conditions and representations (of any kind) not expressly set out in these terms and conditions are hereby excluded (except in the case of fraud).
12. These terms and conditions and all matters arising from or in connection with them are governed by English law and the courts of England will have exclusive jurisdiction in the event of any dispute. Yahoo! may terminate these terms and conditions and the prize draw if it becomes necessary to do so due to circumstances beyond its reasonable control.
