Comp Complaints Still ASA?

I won £100 on a FB advent this week, except I didn't and I think I might complain. Years ago we had a Mr Mutton at the ASA who was fab at helping with that sort of thing but I know I'm a bit out of date. Does anyone know where we could lodge a problem with a comp?

Also I'd appreciate your views on what happened. The page did say a winner would have 24 hours but never returned to the post to say winners were drawn and to check inboxes or even reply to my winning comment. The page itself never messaged me but someone from a PR company and of course it went to my 'Message Requests' and I wasn't notified. Despite checking it regularly I was still just outside the 24 hours and they have read my late replies but won't acknowledge me.

It feels very unfair as there were many other ways to attempt to contact me and they as of today still haven't publicly announced any winner, whether me or an alternate. The ASA website does have a whole section of guildelines on contacting winners and they give an example that making a single phone call is not considered enough and I have referred them to that advice on the web.

I know some might think I should put it down to experience but I've had no other wins for my weeks of hard work and £100 would be a lot of money to us. It's left a horrible feeling too and feels very unfair the way they've conducted themselves and not in line with what 99% of other pages successfully do.
But there are dreams that cannot be,and there are storms we cannot weather!

    From what you have written they have stuck to their terms and conditions, they did what they stated they would in making contact with you, if you didn't respond because of not checking that extra folder (I don't use fb nowadays so presuming like the others folder) then it is a fair redraw or forfeit of the prize.


    Hate saying that but we would all be kicking off if it was the other way around.


    I truthfully don't think the ASA will find different.


    That's my opinion though and I hope I am proved wrong.

    It’s really quite easy to run a case through the ASA. If you really feel that you have exhausted all channels of communication then open a case on line.
    You will be allocated an officer by the ASA and they will proceed with your case and communicate on your behalf.
    All you have to do is send the basic info over to the ASA including screenshots/ photos and details of prize, company, comp details etc.
    It costs nothing and you have nothing to lose.
    You still may not get the result you hope for but they will try hard to get a good result for you.
    I have used them twice and received my prizes.
    It is not a short procedure though, it may take several months.

    I agree with toniq. They might have acted "unfairly" but I don't see they've done anything wrong.

    They did notify you, you failed to see it within the allocated time frame so they've done what they said they would and redrawn. I'm not sure the ASA would look at your case as I don't think they've breached any rules.

    It could have been an Advent style comp if it was only this week where it's a bit more "bish-bash-bosh, out-the-door", so everything runs on a quicker timescale ... including the entry process and deadlines.

    Yes it would be the ASA now but that was probably Edwin Mutton at the IPM who retired about 4 and half years ago since when they have become much more business focused.

    If the T&Cs don't say anything about timing to claim the prize then the company should make all reasonable attempts to contact you and if it doesn't say so a rapid response should only apply if the prize is date sensitive (event tickets/premiers/holidays etc).

    Where the company clearly set out a time limit (at the time of entry) then claiming can almost be considered as part of the competition - answering the phone within 5 rings on some of the radio ones, replying within 5 days to one e-mail for the click to wins and for time critical ITV ones you have 3 hours
    "the Promoter will try to contact the winner on the phone number (or other method of contact (if appropriate)) provided, calling three times in a three-hour daytime period etc)
