Lloyds Debt

Morning All,

Quick question....

I am contesting a debt with Lloyd's which having received documentation as part of a DSAR request, looks like Lloyd's have allowed my account to go into an un authorised overdraft, and then charged me for the privilege although the have also allowed 2 debit card payments through as authorised rather than declined them....

Whats my best course of action.

    HAHAHA, people are literally arguing on another thread about banks possibly removing overdrafts, explaining about how people will be unable to pay important bills and be hit with heavy consequences, court and prison.

    Yet here, you're annoyed the bank has paid a debt you didn't put the money aside for. And you seem to be after advice on how to take them to cleaners over it.

    The current accounts T&C's will almost certainly allow the provision of an unauthorised overdraft.

    There's no pleasing people.

    It was a cash account, which had no overdraft facility either arranged or unarranged, so lloyds have in fact broken there own t&c's

    Page 2 of the Lloyds Cash Account handbook;

    Monthly Maximum Charge for Unarranged Overdraft Fees and Interest:
    The Monthly Maximum Charge for your Cash Account will be £30. This is the maximum amount that, under our charging policy terms and conditions, we will charge in any monthly billing period, for using (or trying to use) an Unarranged Overdraft.

    So there clearly are provisions for unplanned overdrafts on cash accounts. I still think this is a case of wanting your cake and eating it. There's a lot of companies that will fine you for missed payments should Lloyds have declined to loan you the money, imagine if you'd been in a restaurant or using your card to get off the London Underground, etc.

    However, as Sourcrates said, if you feel you have cause to complain then use Lloyd’s complaints procedure.
