Legal help franchise no contract

Hi
Been friends for 15 years. Had a franchise for 15 month no contact just verbal paid him 10% of my in take very week without a fail.
Our friendship changed due to the fact that I wouldn’t sleep with him. He is married, and also I recently got baptised. Since my baptism the next day he rang me and said I need to pay him a set fee each week rather that 10%. I said no. I drove to see him. He was abusive and evil agreed I give him a notice. He had access to my business account which I didn’t know I gave him acces initially. He has disconnected my phone line and gained business through my published adverts which I paid for. I have lost circa 12k of gross income in last 6 weeks. I had to set up a new business myself.
I am a single mum with 3 kids. I am not on any benefits, sir to the loss and setting up a new business I don’t really want to pay legal advisor was quoted 300 per hour. Is there anyone who could provide free initial advice then if there was a case I would consider to take action.
I had a Limited company using his name now I set up
A new company. Can I still go to Emloyment tribunal for discrimination on Sex Religiion? Also what about the clients he also has taken which were generated by me.
I could you please direct me to a right place. Many thanks x

It doesn’t sound like you had a franchise arrangement.
Book a session with citizens advice or google free legal advice - I’ve seen others post here that some law colleges offer free advice consultations.Originally Posted by shortcrust

Ok here goes:
You ran a franchisee business which you took over from a friend.
You paid 10% fee to him.
- you were not an employee; so you cannot go to an employment tribunal.
( nor were you discriminated against based upon gender or religion )
Since you handed back the franchise by giving notice, you are not entitled to keep those clients.
Any money you are owed, you will need to go to court for.
And being a single mum is irrelevant.0 -

So just to be clear, you were not a director of this company? You just took in money and then paid a percentage of it to someone else's company?
If you were earning money, but was not a director of any company, have you been paying tax on your self-employed income as a sole trader? Which legal entity paid for adverts etc - you or the limited company owned by someone else?
Right now, I find the situation very unclear as to what the legal relationship between you, the third party, and the business actually was.0 -
Congratulations on your baptism.
I'm sorry to say but I think this is one best just to walk away from. You don't want or need that individual in your life. From what you've said it looks like you were successful in running the business and hopefully your new business will succeed too.
You could spend a lot of time, money and energy over this but only you will know if the outcome would be worth it.0 -
Whatever agreement you did or didn't have has been terminated. In the absence of any written terms, unlikely you can recover anything.0
