Holiday instead of pay

can my boss pay me in holiday days instead of money. I am getting told that I will get paid for 24 hours at min wage, but I will be working 40. I am getting told that the extra hours I will do I can take as holiday next month. If I don't agree to this I am being told that someone in the shop will get laid off.

If you want legal advice please book a session with a lawyer, many offer free 15/ 30 minute initial consultations. Don't rely on strangers on the internet.
As its a shop and I presume this is a busy time of year, so it does make sense to do extra time this month and get more time off next month - saves overtime rates and matches workforce to demand. Given the precarious state of the high street newspapers keep reporting i imagine doing time in lieu is not uncommon.
The only bit that strikes me as odd and maybe a little passive aggressive, is the threat to do overtime and have time off next month or someone's laid off. It doesn't sound like a business that will be around long term.Originally Posted by shortcrust

If the holiday is paid then yes it is legal, it is normally known as time off in lieu. Last company I used to work at paid salary based on a 40hr week. When we did system installations you could end up doing 60hrs so the additional time was repaid by taking the time off on pay.This is a system account and does not represent a real person.
