I would write, but not be as specific about concerns as TBagpuss suggests. I would word more along the lines of "There is an item entitled 'Uplift' on my final payslip. Can you confirm that is for my earned but untaken holiday". If they come back and say it is, no problem. If they come back and say whoops we have overpaid, still no problem as you have flagged the payment to them.

    Pretty much nails it...

Previously id have said just keep it and repay if asked, but it all depends if you want this to hang over you or just deal with it as suggested above,id say deal with it and who knows you may well be entitled to it..bonus...if not repay while you still can without it causing any shortfall in the coming months,

Option 1 - Make queries with your previous employer, If they tell you no error. Then you're clear.

Option 2 - If they tell you it was an error they may ask for it back? No future hassle.

Option 3 - Sit in limbo and wait for the day they MAY or MAY NOT come knocking.

I'd go for option 1 or 2 personally.

You are probably not actually, as they could still almost certainly ask for it back several years down the line if they discover they were wrong.

If they repeatedly assured the OP it was correct then it might just get into the very rare estoppel situation where the OP may be able to lawfully refuse repayment. I wouldn't want to rely on it though!
  • I was overpaid once about 10 years ago and it was a decent sum of money too.

Told the employers HR department, followed it up 3 times.

Each time I was told they would look into it and get back to me.

    No-one ever did.

    So I treated myself.

The problem is most BIG companies outsource everything these days and the outsourced companied do NOT want to admit they have made a mistake.

So they would rather write off a small mistake then admit to it.
  • This happened to me a few years ago, I emailed pay roll to let them know my final payment was too high, they got back to me to say they would look into it, and it was 6 months before I got a letter with an invoice! Luckily I had kept it all in separate savings
