Backdated Pay Rise

Hi all,
Wondering if anyone can help me please. I have written confirmation from the CEO, at the company I work, in May this year he promised me a substantial pay rise and for it to be backdated from 1st January 2018. He promised I would get this money once they had completed capital raising which hasn't happened up until now. Last Friday (30th November) I handed in my resignation which is 3 months notice so my last day will be 28th February 2019. Today my CEO told me over the phone if I am not in employment at the time they complete the capital raising I will not be getting the backdated pay rise. At the moment he has no fixed date for the capital raising to be complete but he also told me it would be sooner than April but can't say for definite if it will be in by 28th February. Obviously I don't feel it is fair for me to miss out on my back pay because I have been promised it already on all my contributions already made whilst my 8 years working with this company. But can I actually argue this legally?

    If the capital raising isn't done by the time you have left you have no right to this promised payrise.

  • Yeah agreed - you may have been promised a pay rise when this was complete but if this doesn’t happen until after you leave then you won’t be an employee of the company any longer to receive the pay rise so therefore there is nothing to back date.
