barred letter sent, but need help please, MAGIC entries on credit file.

Hi all,

After many sleepless nights Ive sent the statute barred letter, with digital signature as advised, via royal mail special delivery to Lowell Financial.

Now I'm scared, I really am.

What will happen now?

Is there a time limit to respond to a statute barred claim?

If the loan is indeed statute barred how do I get the defaults, if any, and Ive not checked yet, removed?

    I have sent the Statue barred letter to Lowell over 8 weeks ago,the only reply i had was how very disappointed they are that i have taken this route.

    They said they have passed it to their investigation dept. which when i posted this on MSE was told it is a filing cabinet in the corner of an office saying uncollectable.

    They hadn't searched my credit file so i thought they were trying it on.

    If you know for sure the debt is statue barred(and there is no CCJ on it) then hold firm don't even reply to letters they send you definatly don't phone.

    I have had letters from them all about old debt lowell and their debt collecton side Red debt collection services once they get the message you will not be paying they ease off not to say they cannot keep asking for you to pay as the debt still exists but cannot be taken through the courts.

    There will be others along with advice who know more about the ins and outs of the limitations act take them all in it helped me a hell of alot when i first started reciving these letters,like you sleepless nights followed but at the end of the day they cannot have what you havn't got.If the limitations act is on your side use it.

    I only think it is statute barred, or almost!

    Lowell had searched my credit file at my old address (Ive just moved) but when I changed my address with Experian the search disappeared!

    Everything else from BOTH the old address and current address remains the same!

    Also the alleged debt WAS showing on Experians files as defaulted 5 years ago but once again, this too has disappeared!

    Whats with this magic stuff???

    Deviant - any idea when you made your last payment on that debt?
    Or when you wrote to a company acknowledging the debt was yours?

    That would be the date from which the 6 years would start from. If they come back stating that the debt is not yet barred (hopefully with details) then you can ask them for a copy of the CCA. This should put another few weeks on the clock and they probably don't have it, so don't worry too much.

    I read that you said if they come back to me stating its not yet barred HOPEFULLY with details, do they not HAVE to give me details if its not yet barred?

    They don't need to give details.

    If the debt is statute barred, you will probably only find out when you have a copy of the CCA. If you have a rough idea of when the last payment you made for this was it would help as you don't want to admit to the debt being yours until after the 6 years are up. (5 if in Scotland)

    Right now i think you will just need to stall and if they just go away as the debt is statute barred - even better.
