Please - need help with HSBC

Me and the missus hit a rough patch last year and couldn't meet our loan repayments. Rather than bury our heads in the sand, we immediately contacted CCCS and they helped us set up a Debt Management Plan. All other creditors have been very helpful and professional, giving us no problems or aggravation and simply accepting the payments.

HSBC is a completely different story.

I have a 20K unsecured loan with them, my wife has a 5K unsecured loan and a £500 credit card. We were about £900 into an overdraft with a £1100 limit.

They told me that there would be absolutely no problem in dealing with the CCCS. We were told by the CCCS that the payments we were offering were excellent, not quite the amount that our creditors wanted but not too far off. We set up a new current account with a different bank, as per the CCCS advice, and made our payments from there.

We cancelled all standing orders on the overdrawn HSBC account. Well, all except two. They point-blank refused to cancel them. I told them that I had a right to cancel any standing order on any of my bank accounts, they said that this didn't apply to these standing orders because they are 'contractual'. They said they couldn't cancel them because they required repayments, despite me continually repeating that we were making payments through the CCCS. They were also telephoning me up to 11 times per day, trying to strong-arm me into one of their 'managed loans' (don't worry, I suggested several short piers they could take a long walk off).

Every month since the plan started, they have accepted the payments from the CCCS, and I have been able to watch my loan amount dwindle. The thing is, because they refused to cancel the standing order, they have also been attempting to take the payment from the overdrawn account. The first time they did this sent the overdraft spiralling over it's limit, so they slapped a £50 charge. They take the money from my overdrawn account into the loan account, then immediately transfer it back as they've already received payment via CCCS. This incurs a charge of £50 every time they do this.

Are HSBC legally allowed to charge my account due to a standing order they refuse to cancel? I'm not sure what to do next.

    Get hold of your advisor at CCCS and tell them. Also put in a very firm complaint threatening to refer them to the Finanaical ombudsman unless

    a) they cancel your Standing order
    b) they refund these fees

    Make sure that you mark this letter to the effect that this matter is not dependent on the Financial Ombudsman's decision on bank charges.

    Do you bank on-line or can you set yourself up and then cancel the standing orders yourself.
