  • It don't think it would be so easy for tesco to sack her. They offered her new hours in new department. The offer was accepted, therefore a contract was entered, its irrelevant as to acceptance being verbal. The unreasonable short notice of the withdrawal of the offer that was accepted could be deemed breach if contract itself.

    Also said withdrawal at short notice put her in this position and tesco no doubt are aware of her new job - that's if she chooses to take the new job. Therefore knew shed be put in an backward position, so any dismissal or resignation could amount to unfair or constructive dismissal.

    I'd recommended that the OP daughter contacts ACAS for advice, as well as tescos HR department. And raise a formal grievance via HR if they can not find a solution or are unwilling to do so.

    Are Tesco aware of the other job? Some companies have a clause in employee contracts where you need permission from the company before you can take on a second job.
  • When you really get down to it, your daughter is unhappy because she feels that she was verbally told she would be able to change her contracted hours.

    Usually, any change to contracted hours would have to be confirmed in writing.

    I don't think Tesco are being massively unreasonable here. If the store is stopping overtime to control wage costs, that is what it has to do.

    The offer of informal overtime is good news.

    What the hell are some of you talking about?

    If there is a clash of time tables between a permanent job that's been done for 8 years and a temporary job then you leave the temporary job not the permanent one.

    If there is a verbal offer of an internal job/shift change and its withdrawn then you stay in your current job/shift. The mobile dept manager is totally out of order asking for a resignation and any half decent union rep should tell them so.

    It looks like the mobile manager has jumped the gun and is trying to dump that problem on the employee where as its the managers problem to sort out with senior management to get the hours right.

    However I agree with Xbigman: someone's trying to pass responsibility to the OP's DD which doesn't really belong there. BUT getting on the wrong side of managers isn't usually a good plan.
