Second mortgage

I currently have a mortgage with my brother. We have had the house two years and are about to go onto another two year fixed term. If I decide in two years time that I want to buy another house with my girlfriend, am I allowed to move out into my new home as my main residence while he is still allowed to stay in the house we own as long as the mortgage payments are still being paid?
