Moriarty Law 5 year old policy debt

I received a letter from a firm called Moriarty Law and thought it looked a bit dodgy, it was asking for £176.00 for an outstanding debt. As I didn't recognise it I asked them to send me proof in writing.

They have now responded and want payment in 30 days, it is for an old car insurance policy that I cancelled and disputed in 2013.
Can I dispute this?

  • You may find it’s time barred ? I had similar with a House Insurance cancellation where it was claimed a claim had been made on the policy hence charging for the remaining 4 months plus £110 cancellation fee - I kid you not. I fought them all the way and counter claimed for Harassment.
    They were in a complete spin, used to people just paying up, I basically rubbished most of their evidence or lack of, it was inaccurate, full of mistakes and I accused them of Professional misconduct and deliberate obstruction ( refusing my reasonable request for proof ). It went all the way to the Small claims Court -cost me £35- and on the day their Advocate couldn’t wait to get hold of me and strike a deal, ended up both agreeing not to pursue it and went and sat in front of the Judge where it was dismissed along with my counterclaim, no costs awarded to either.
    In hindsight I should have continued with my counterclaim, but was still happy in successfully defending to the point where they caved in. Moral to the story is if you feel that you really don’t owe someone money or the amount they claim call their bluff every time and take it all the way.

    As far as Moriarty Law is concerned you should continue to deny the debt.

    If this was a valid debt it would have been due as a cancellation fee and remaining term insurance payment, as above. This would have been payable on cancellation and so I think technically that date would be the 'cause of action'

    If you live in England /wales, they have six years from that date to start a court claim. After that they're out of time and you can insist they stop pursuing it. That may be the easiest way out of this

    So what is the actual date? Ask them for more details without acknowledging that you owe anything.

    If they did start proceedings you would dispute liability but that is unlikely for that amount.

    Of course you can dispute this, and ignore there make believe time scales as well, always send disputes in writing, and never engage with them on the phone.
