Can i ask what is the difference between the
County Court Money claims
And the County Court Business Centre ?

I have a letter for the CCMC in Slaford ?

Could this be lowell up to there dirty tricks again or can credit agreements or business claims fl ot go through this court ?

If anyone knows the difference between the two courts that would be great.

    There are many differences between the two courts, but basically NCCBC (MCOL) issues claims online (with a restriction on the number of characters which can used for the Particulas of Claim and it's cheaper for the Claimant) which are for a specified sum of money.

    Claims issued on paper go through CCMC (Salford) for an unspecified sum of money, such as personal injury or damages based claims.

    Lowell usually use MCOL so what is this claim for?

    The debt was disputed to very over us not paying it due to them having the goods returned but refusing to say they recieved them.

    So we stop paying the account and it was then moved to lowell who was not intrested in our story.

    Does this mean you have received a claim from MCOL (NCCBC)?

    If so you should login online using the password on the first page on the claim form.

    You need to file your Acknowledgement of Service by ticking the box which says you "intend to defend all of the claim". You can always change your mind later. Don't enter anything in the Defence box at this stage.

    You have 19 days from the claim Issue Date (top right on first page of the claim form) to file your AOS.

    You will then have 33 days from the same claim Issue Date to file your Defence.

    My suggestion is you send a s 77-79 CCA Request to Lowell because if they can't/don't comply with your request within the statutory time frame the debt becomes unenforceable in court unless or until they do comply.

    Lowell may struggle to produce a compliant CCA Request for a Very account.

    You can also send Lowell solicitors a letter headed "CPR 31.14 Request" where you can ask them to produce any documents mentioned in the Particulars of Claim (third box down on the left side of the claim form).

    This could be the credit agreement or contract (even though you'll be requesting that in your formal s77-79 CCA Request), the Default Notice, the Notice of Assignment and the Deed of Assignment.

    If the claim has been served by Salford the same suggestions apply only you'll be responding on paper so check the deadline dates.

    If you've not yet received a claim (that's not clear from your post) at least you'll know what to do if that does happen :)
