Marriage tax allowance P11D

Hi my wife earns under the threshold to allow us to claim back through my salary we filled in the online forms etc heard we would be able to claim! Back over £600 odd.
We didn't hear from hrmc for about three months we called them and spoke to my wife verified her details etc. They said they require my p11D from my prior employer for 2017/18. I contacted my old work and they advised it's not been filed with hmrc but the told me if they submit the p11D now, bear in mind my tax code will change and will end up paying more in tax!? The person on the phone at HMRC said they just require the figure only over the phone.
I'm not sure if i should tell my prior employer to submit my p11D and how to deal with all.
The only tax on it will bemy BUPA healthcare...which I never used.. irrelevant i know...What should I do? I assume it has to be legally submitted by the following tax year anyway right? Which would outweigh the other? The marriage tax allowance or the P11D benefits..? Any advice is welcome!!?

Your employer should have filed the P11D by July 2018. Did they say why they haven't filed it yet?
Whether you used the BUPA cover is utterly irrelevant.
They should also have provided you with a copy of the P11D, presumably you havent received that?
Which tax years has your wife applied for Marriage Allowance for and which tax year did she actually make the application in?0 -
Thanks for your reply my wife claimed the last two years and made the application to HMRC about 4-5 months ago this year. My prior employer most likely forgot to submit it and I didn't get sent a copy so I had to chase them.!"£$%^&*()0

So you have got £400+ of the £600(+) resolved and just need 2017:18 to be sorted.
Not sure quite how you can resolve this if the company aren't playing ball.
You could try asking HMRC if they will accept that whatever Medical Insurance benefit was included in your tax code for 2017:18 is the actual company benefit for that year but that could then mean you miss out on a bigger refund than the Marriage Allowance is worth (if the benefit was much lower because you were only with that employer for part of the tax year?).
But at least you would then get the £230 benefit of Marriage Allowance for 2017:18.0 -
Is the P11D from a company you stopped working for during 2017/18?
If so, was the medical benefit included in your code number for 2017/18?0 -

I fear that makes life more difficult.
HMRC clearly know about the benefit but you haven't been paying tax on it (in 2017:18).
So you will owe as yet unknown amount of tax in respect of the benefit and the Marriage Allowance entitles you to £230 off whatever your tax liability is for 2017:18.
Not sure quite how you resolve this other than taking it up again with your old employer. But realistically as they are your old employer that means they are less likely to be helpful.0
