Hi everyone
I have previously posted about my Mum dying after I had declared bankruptcy and that I will be receiving an inheritance which will allow me to annul the bankruptcy.
When I advised the OR about it I received a letter with the following clauses “I am writing to inform you that the official receiver claims your inheritance as part of the bankruptcy estate. The property now belongs to the official receiver as trustee of the bankruptcy estate. YOU SHOULD NOT SELL OR DISPOSE OF THE PROPERTY “
If I can’t sell the property how can I repay my creditors and annul the bankruptcy?
My Brother and I are the executors and he is concerned and confused by this.
Can someone please advise me if I have interpreted this incorrectly.

As a bankrupt, the OR claims the inheritance, uses it to clear the debts in bankruptcy and returns any excess to you. You should renounce your role, leaving your brother to act as sole executor.
He can then liaise with the OR, take the estate to probate, and dispose of the property as necessary, paying them your share of the inheritance.0 -
Thank you for responses. Probate has been granted. We are now waiting for property to be sold and the OR can then receive my share.0
