Debt from 2009

Hi, I'm hoping someone can help me...

I have an old debt which was orginally a provident loan. The amount owing is £1200 and I was paying a token payment each month, until I switched bank accounts and forgot to update the detials. I have been receiving letters which have now mentioned them taking it to court. I am terrified that I will get a CCJ and lots of fees added.

I don't have the money to pay it, I suffered a spinal cord injury in 2015 and I am now paralysed, so unable to work and my disability benefits barely cover living expenses. I really don't know what to do!

Would they be likely to get a CCJ? I appreciate it isn't statute barred even though it is from 2009 as I have made payments.

    Have you got in touch with them to reinstate your token payments?

    Did they refuse to accept them?

    Just general collection letters, there most likely course of action will be either to sell the debt or instruct a debt collector to collect it.


    Makes no difference what they do, you should not worry about it, they can`t take what you don`t have, even if a CCJ was obtained, you would still pay that at the token payment amount, so they would ,not benefit from court action.
    You really should write and explain your situation to them.

    I'm going to suggest you do two things :)

    Firstly, send a s 77-79 CCA Request to the current debt owner for a copy of the original credit agreement with Provident Loan. If they can't/don't comply with your request within the statutory time frame then the debt becomes unenforceable until or unless they do. This should quieten things down for a while.

    Some debt owners (but not enough!) will close an account or cease collection if they can't comply with a CCA Request. Was this originally a doorstep loan?

    Secondly, see if the current debt owner has a "Sensitivity" team who may be more understanding of your current situation whereby you can hardly make ends meet trying to manage on disability benefits. Ask them to write off the debt under the circumstances.

    I have had Provi write off debts in this sort of situation
