Problem correcting credit account

Hi All,

I was discharged from bankruptcy in March this year. My bankruptcy date was March 13th 2017.

I have used the excellent advise and templates here to correct my credit record and this has been very successful.

I have one last hurdle - Barclays. I had a current account, credit card and a loan with them. The details have been corrected for the current and credit card accounts but they are refusing
to correct it for the loan account..

Their letter reads:

"I have now investigated this matter and can confirm the default showing on your credit report for your loan account is correct. This is 12th April 2017. I understand you were advised this would be changed to 13th March 2017 however I have liaised with our team who has confirmed because this is a loan accountm the default date would show as 12 April 2017. This is because we sent a letter dated 14 March 2017 which was a notice of default which was due to expire on 11h April 2017. On 12th April 2017 this noticed expired and we registered a default accordingly which we feel is correct and an accurate reflection of the account."

So my question is- My understanding was all debts associated with the bankruptcy would be show as default of on or before the bankruptcy date. Is this correct or is what they state above correct?

    it should show as defaulted form date of Bankruptcy.

    the defaults will only drop off your file 6 years from date of default - bearing this in mind, is the extra one month (61 months instead of 60 months) worth the hassle?

    you could respond to them saying as follows (courtesy of Debt Camel)

    I [went bankrupt at xxxxx County Court / had my bankruptcy application approved] on dd/mm/yyyy. I attach a copy of my Bankruptcy Order.

    I am writing to ask you to correct my credit file for the above debt. At the moment [there is no default date shown / the default date is shown as dd/mm/yyyy]. This is incorrect and a breach of the ICO guidelines and the Data Protection Act 1998. There should be a default date not later than the start date of my bankruptcy.

    Please correct this entry within 28 days or supply me with a written reason why you will not do so


    if it were me, id send them a final letter, but wouldnt waste the energy on the extra month (would be chasing if it were months past the bankruptcy date)

    Thanks for your reply.

    I have already sent that letter template which initiated their response.

    I understand the record will drop after 6 years but I was under the impression that having this date display outside of my bankruptcy could further negatively impact my credit report (its bad enough already!)?

    I am hoping to purchase a house with my wife in the next few years and want to give myself the best chance and so I need to make sure even i is dotted and t crossed if that makes sense.

    I understand my next course of action would be the ombudsman but is there anyone that can point me in the direction of whichever rule or regulation they are contravening by not updating this record? If I can see that I might be able to attempt one last effort with them without going to the Ombudsman?
