The op needs to keep good records that show they were denied the ability to take statutory leave(on work days) and they were not allowed to carry over.

Claims for that holiday on leaving have had some success.

But, on the limited info in the OP, he hasn't been denied stat holiday, just not been allowed to take paid holiday when he would be off anyway.

OP they are acting perfectly within the law, it's illegal for them to buy back any of your stat min leave.

When I worked for supermarket chain, they would often deny holidays until it was too late...you'd end up with a month off just before the holiday year end !

    Too late for who?

Provided you could take your holiday at some point, however inconvenient to you, it is perfectly lawful.

In theory an employer could insist you take the last 28 working days of the holiday year and allow no other leave whatsoever. OK, they might struggle to recruit and retain staff but that is another matter.

As in they'd left it too late to take holiday at any other time, other than the full lot at the end - basically the last part of your post was what used to happen all the time. And yes, they struggled to recruit and retain staff.

My dad works for a large chemical company and pretty much has November to December off every year because of this! There is an element of shut down over Christmas but not November to Jan
  • thanks for all the advice.

the reason i applied for holidays on days i was not working, was to avoid the 'we do not have anyone to cover your absence' excuse.
which seemed more valid than 'we don't have enough budget this month' excuse to refuse my application for holidays.

anyhow, after a rather heated discussion, the manager and I have found days that are acceptable to both.

It does seem that rights and respect in the world of part-time employment are hard to come by these days.

    regards to all

Your issue had nothing to do with rights and respect of part timers.

You tried to gain extra money through holiday, your manager had the 'right' to turn it down and appeared to do so respectfully.
