Social services care assessment

I hope this is the correct forum for my query.
My mother has been in a care home for 7 months, part funded after a social services assessment by the local authority. She has £22000 in capital. Her assessment includes a £24.90 per week personal allowance for toiletries, hair does etc etc. She still likes to give cash presents on birthdays to members of the family. If over time the amount drawn from her bank ie pension income and capital is greater than £24.90 per week, will we run into difficulty with the local authority.

As I understand it, the LA will have to pick up the tab once her capital falls to under £14,250.
Given the cost of care, it may well not take long for this to happen but the LA will be on the look out for it's happening before it thinks it should?
Presumably relatives understand that her circumstances do not permit generous gifts - she might be well advised to make such gifts token amounts - it's the thought that counts!0 -

Would the LA consider is deprivation of assets ?
As with anything it depends on the amount.
If its £20 or even £50 to grandchildren for birthdays and Xmas then almost no, it wouldn't be deprivation of assets.
If she gave her son or daughter £8k - then that would be considered deprivation. Although in fairness the rules are really designed for people with significantly more assets than this.
She is already under the upper capital limit of £23,250 so she is treated as having a notional £31 a week of income, so that is her contribution to fees.
