Is it harrassment?

Just to give you a bit of background I owed some money to a certain bank for a loan and cc . An agreement was made for the loan and cc debt which was paid in mid August. In Sept I get clled by CC branch of the company that said I still owed them the money, even though I said that I had paid it as part of an agreement. Luckily I had this in writing and had names. Howevert, they did not want to believe me as they said they did not do f&f settlements. They traced it through and agreed that it had been settled. In Oct I get another statement from cc company saying i was in arrears so I called and the same thing happened again. I also got called from the collection part of this company. I had to go through the same thing all over again and even had to fax a copy of teh agreement. It was agreed again that I had paid it off and owed no money. And just a few days ago I got another call with the same thing and a letter in the post and another statement. My credit history/rating has also not been updated. Saturday I got through again, went through the whole story again and the girl promised me ( 4th promise) that this would be sorted and today I get another letter saying I was in arrears. I agreed that this has probably just been crossed in the post but I called them anyway just to check it was on my file. 30 mins late I get chased by another staff member saying I owed them money.

Every call I take I get a promise taht I will not be called again, yet I still am being called.

I s there anything else I can do? Are there any rules or laws about this kind of thing and updating records within a certain limit?

I am feeling extremely harrassed and my integrity is being put into question ever time they ring as they don't believe me because they say they don't do full & final settlements.

Any advice appreciated. I was obviously pretty lucky to get this agreement but the calls are annoying now.

    Several options really.

    You can complain to Trading Standards and/or the Financial Ombudsman for starters.

    If you wish to go through the FOS, you should initially send a formal letter of complaint to the creditor who must investigate and send you a "Final response" within 8 weeks. If your complaints aren't resolved after that then the FOS might take up the complaint if you submit it formally to them. That costs the creditor about £400 whatever happens, so they won't what that to happen. :)

  • sounds like it to me and I'd complain...the debts paid, they've agreed it, the loan's been paid and that should be it! Let us know how you get on but if I were you I'd be doing a letter to the ombudsmen stating facts and also that credit file not updated plus getting ridiculous amounts of calls about a settled debt..

    You should also complain to the Office of Fair Trading, when you complain to both these and trading standards please state that you do not consider the creditors fit to hold a credit license as they have breached OFT debt collection guidelines.

    Also, please do not be intimidated by the calls. When you do receive calls, refuse to confirm your personal details which should make them *** off (if they confirm ANYTHING, including that you have a debt, without this they are breaking the DPA).

    Please do not be intimidated. You have the F+F statment and a receipt in writing, so you are within the law and morally have done the right thing. It is the other guys that are behaving badly.

    Thinking about it, didn't Weller get an apology and stuff in this situation? I can't be sure but it kind of rings a bell?!

    Thanks so much to both of you and the links have been helpful. I will use this info and certainly complain. I'm fed up of being nice when they clearly are being so incompetent. This is a well known supermarket affiliated bank that should have proper procedures in place.

    I got the girl to read the last thing on my file today from Staurday and she actually read out " Do not call the client to collect from this account" What a beauty!
