Mortgage Charge

My remortgage is now being held up as Evolution money have failed to remove the Charge marker on deeds (we took out a small secured loan on house in 2016 and paid in full by April 2017).
We assumed this was removed after full and final payment made,discovered couple of weeks back that it had not,contacted Evolution who apologised and stated it would be actioned that same day and off the record in 72 hours.
Its now been a week and its still on there...they state they contacted Land registry and its not there problem.
So question is..as they have not removed it and im now going to have to pay another months mortgage payment due to Evolution holding the remortgage up,will they be liable to reimburse me for any out of pocket expenses due to there mistake.

The mortgage payment will be factored into any settlement figure for your current mortgage.
What out of pocket expenses are you going to incur. Your solicitor will be handling this.
Land Registry cannot be dictated too unfortunately.0 -

Yeah understand the settlement figure will be included..but if for arguments sake solicitor is ready but cant proceed due to the charge on the deeds not being removed after 18 months of settlement and being asked twice to update Land registry,then i"ll have another month of paying high mortgage rates 5.07% as opposed 1.96% solely down to Evolution,so in my mind they should be paying for the mess they made...?
Appreciate Land registry cant be dictated to,wasn't suggesting they can be...my question was regards Evolution and them stating twice the Charge would be removed and that it takes up-to 72 hours.0
