Fyi.............

Family member went BR a few weeks ago, all went sweet, he had his telephone interview, got his BR welcome pack :D


Today he had an annual review with his housing officer who said she knew about his BR as the IS had sent a copy of the BR certificate, luckily she wasnt bothered but it could have ended badly.........

    Were there rent arrears included in the bankruptcy? Otherwise I am struggling to see a justification for the OR contacting housing.

    No arrears of rent or CT, if it had been a private let the tenant could now be homeless...

    Is this another sledgehammer to crack BR's over the head with? like a life sentence in the Gazette..........

    I’ve recently signed another contract for 12 months and there’s no clause I can see about bankruptcy but even so it’s a headache I could do without! I could end up homeless!

    Hi, we asked the OR when we had our interviews if the letting agent needed to be told as we were terrified of being made homeless. She said that they didn't normally contact them if there were no arrears, and we have certainly had no comment from the agent since our BR in September.

    Generally the OR will only contact the LL or LA's if there is any arrears. However, my OR asked for a copy of my Tenancy Agreement to check whether there was a BR clause in it. There wasn't - but if there had been, the OR told me she would have informed the LL regardless of whether there was any rent arrears.
  • Thanks both for your replies! Makes me feel a little less worried. I’ve been over my tenancy agreement with a fine tooth comb and can’t find anything - unless it’s worded incredibly cryptically! I’ve never once been late with my rent in all my year of renting property and often pay it early in the flat I’m in now. Fingers crossed eh?

    Not to worry you but my Examiner wrote to our landlord when we had no arrears.
    Luckily I’d already told him about it and there were no issues but we had no rent arrears so that’s not always the case.

    I specifically asked mine not to tell my landlord ( I had no arrears etc) as I live in a small village and it would be round everyone within a day if she did. She agreed not to tell. Like so many aspects of the procedure, it seems to vary so much from OR to OR. I also hate to think it, but mine certainly seemed more sympathetic and flexible in how she interpreted the rules than some others on here. It shouldn't happen but...

    I’m obviously going to have to beg and plead for them not to contact them. I don’t know how I stand legally with just having signed a new 12 month lease and whether they could get me out without a bankruptcy clause but I don’t want to risk it. I will literally be homeless if evicted. My family are 2 hours away and they don’t have room for me anyway. I’ve only just moved in 7 months ago and I love it so much. It’s nigh on impossible to rent around here without using a letting agent as well
