    I phoned up M&S customer service in relation to the conflicting info.

    They state that the 90 day policy was retrospectively introduced in May .

    I argued that it was not fair to introduce something without making people aware and that at the point of sale (staff had not mentioned about the change, which CS admtted that staff had been informed in March 2005 about the change).

    CS's response is that whilst they are aware of this, their stance is firm and is listed in all shops.

    NOW if someone has something concrete which states the policy is not being backdated or works for M&S and can endorse this view please let us know as I have a few things that are not wanted but outside the time!

    We had huge notices up in our local store from the middle of April stating the date in May on which the policy changed. They have been operating the 90 day policy since that time.
  • 90 days is a more than fair returns policy in my opinion, I am sure that there were people who abused the returns policy in the past and I think its only reasonable to expect an item to be returned within 3 months for a refund.
  • how do you get the 90 days making the last date tomorrow?

    The new policy commenced 4/5/05 hence 90 days from this should be about 2/8/05?

    Or am i missing something here?

    Not idea how its tomorrow but I just got 100 pounds back today and the stuff was over 90 days.
    Anyway i didn't calculate it - I just asked their customer services. The girls in the stores seemed to know about it being imminent too

    Remember folks that they can't do anything to effect your statutory rights, so if you find the goods are faulty at 120 days (the zip breaks for example) you could still return the item.

    Also if when you bought the item there was unlimited returns then this still applies. In law it cannot be retrospectively added to the contract as far as I know.
  • Martin -help please -35 days ok -I understand the reasons for this, but if I still have my receipt, even after 35 days, surely legally they cannot get away with giving me the last sale price ( in this case, 1/3 of what I paid ? )I feel I'm being robbed -a loyal , lifelong M & S customer outraged by this.
    What does the phrase 'after 35 days you may still be entitled to a refund in line with your legal rights' mean ?? surely I'm entitled to what I paid, with my receipt as proof ? Checked both Monsoon, & Next policies are not in line with this.

    If M&S take the item back from you the most they will be able to re-sell the item for is the last sale price - they are being very fair giving you 35 days to return the item, as this is still longer than any other high street store.

    They are acting within their legal rights - sorry.

    Next's official policy is that you'd get the last selling price onto a giftcard if you passed the 30 day mark

    Out of goodwill they may give you a refund but they've no obligation to

    by in line with your legal rights I think they mean if the goods were faulty you could get a refund but not if you change your mind.
  • I work in retail and am surprised at how long people keep things before they return them. I understand some people may take a while to return things due to distance to travel, other commitments, etc but surely within 1 month you know whether or not you want the item.

    Another take on the matter is would any of you want to buy an item that has been sat around (normally screwed up in the bottom of a bag) at somebodys house for 90 days plus? for the full selling price?

    (EDITED TO ADD, obviously products that have been unused and not faulty)
    finally debt free and want to keep it that way!!
