Salary sick pay (TUPE)

Hi,
The company I’m with has recently TUPED all staff to a new company. (Some staying in the same location atm)

I have always been paid my normal salary when off sick since I went from hourly to salary pay. ( 2 weeks in the last 4/5 years).

I am currently off sick and the new company have just paid me SSP and not full.
Is this correct? I thought everything should be transferred?

Note 1: my contract is from 2004 and states I am on hourly pay this is now not true.(they know I’m salary)

Also all other employees from the original company were always paid full salary too.

    Possibly. Stage one.... Have you asked them? It could be a mistake or an oversight. Your previous sick pay could have been discretionary. We aren't the employer and can't advise unless we know what the employer says.
  • I’ve only just got back off of holiday (which was booked months ago) and I was paid whilst on holiday.
    If it was discretionary (from my previous employer) that would be the end of this?

    Correct, unless any undertakings were given when you were TUPE'd over. Doesn't sound as if that is the case.
