Final Questions on court forms for tomorrow

1. Do we complete the form 6.27 the debtors bankruptcy petition before we go?
2. Do we complete the form 6.28 (affidavit form) before we attend court?
3. As OH needs vehicle for work do we ask for it to be exempted anywhere on the forms?
4. When do we put forward our reasons for keeping this vehicle (think it may be classed as value too much to keep) but want them to know that the service light is on for a major service (cam belt etc) and reasons why it is ideal for OH Business, reliability and economy very important because of stop start nature of employment and being dual purpose for family as well as employment so cuts cost of running 2 vehicles ?
5. Have asked this on another thread but thought i'd add it here as well, i have an Abbey Biz account (unused for last year) but OH is an additional user on it having an Electron Visa card (can only withdraw money that is in there, account is checked evertime its used or pay in money), do i declare this on forms as i'm teh main account holder and not him?

Yes, you need to complete the forms before hand and I think you need to take 3 copies with you.
As for the car, all the info I've ever seen posted here says that a vehicle worth over £2,000 will not be exempt. If the vehicle is more than that the OR may let you have some money towards buying a cheaper vehicle. It doesn't matter how low cost his current one is to run, it is the overall cost of the vehicle.

If i have understood it correctly because OH needs a vehicle for his employment (not just going to and from but actually in the course of his employment) which OH does, then it can be exempted, wasn't sure if we had to put this anywhere on form or if its raised at the OR interview?
Because its worth over £2000 we will probably lose it on that aspect, we can't see how after costs etc that they will make much at all for creditors especially as they give you up to £2000 back to buy a cheaper vehicle. We love what we are doing and we love why we're doing it!!0 -
1. Do we complete the form 6.27 the debtors bankruptcy petition before we go?
Yes, if you like. Although it's so full of legal jargon that most court clerks will help you complete it on the day if you have struggled.
Leave it unsigned and dated though, since you do that at court.
2. Do we complete the form 6.28 (affidavit form) before we attend court?
Same as above.
3. As OH needs vehicle for work do we ask for it to be exempted anywhere on the forms?
I would explain the circumstances in the extra info section (S 13). You would have a chance to make the case at interview, but giving the OR a heads up on the situation will help smooth that over and make any decision by them quicker.
Put it in writing in the forms (S13) and repeat at interview.
5. I'm not sure of the status of that account, since business ones are a bit different to the ones I'm used to.

How much is the vehicle actually worth?
Thanks for advice Fermi, i did wonder if i could use the extra info part.
The car is worth about £3000 so i think we are going to have get a cheaper one especially as its OH only asset but we want to state our case for keeping it and see what happens and once OH health improves he is thinking about courier work which again our vehicle is ideal.
Have said to OH to expect it to be taken and if it isn't its a bonus. OH is having a "bad" day worrying about tomorrow, i think we are almost ready. We love what we are doing and we love why we're doing it!!0 -
If it's £3K you may stand a slim chance.
£2K is the official figure, but that normally goes up to £2500 once the OR has had to factor in all the costs involved in realising the vehicle.
If you make a really good case they may just decide it is not worth bothering with for an extra £500.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
