Sick note, new job, constructive dismal ????

Hi all

hoping someone can help me as ACAS have been really unhelpful.

So here it goes i am currently employed and have been with my current employer for last 3 years. Although I transferred location as result of promotion. (continuous)
since I have been at my new location I have had ongoing issues with 2 members of team in regards to there conduct, but as a manager I feel it is 2 against one. this has then lead to a letter of concern for myself without a chance to defend myself.

both current manager and previous said they agreed that these two employees were not performing correctly and would take the right avenues in regards to performance review this has not been done.

forward to current day, I have been signed off from work on a week by week basis (only first week) with "low mood" and my employers are aware that is ongoing issues with my mental health so was no surprise to them.

I have managed to secure a new job starting in 3 weeks, but my notice period is 4 how do I go about this ..

please someone help this is causing me more pain than good I loved my job so much before them and now im forced to leave.

    How about telling your new employer you're on 4 weeks notice and see what they say?
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

Have you told them you are currently signed off sick? Why does the job start in 3 weeks when you are on 4 weeks' notice - what do you expect your current employer to say in any reference they are asked to give?

    You haven't been forced to leave. You've chosen to do so.

    It's definitely constructive dismal.

    But not even remotely constructive dismissal because nobody is making you leave. Here's a thought... Tell your employer you don't want to come back and intend to stay signed off sick, so will the accept your resignation? Honesty. Works well a lot of the time.

    Bear in mind that the reference your employer almost certainly had asked for by now might not say what you want either....
