CCJ timeframe

Hi all,


I have received a claim form through from Northampton Business Centre. It is a legitimate claim by the looks of things; and I have asked for the additional 14 days to defend my claim.


I was just wondering if anybody could give me any advice as to when the CCJ will be issued? The reason I ask is that my understanding is; if the CCJ is paid in full within 1 month of issuing, it will be removed from Credit File.


I will be able to pay the CCJ in full at the end of November. The 14 days I have to defend my claim expires on 11 October 2018. If my defence is unsuccessful, how quickly is the CCJ likely to be issued? (What I am therefore hoping, of course, is that if my defence is unsuccessful, the CCJ might not be issued for a few weeks, meaning that I have until end of November to clear it and wipe from Credit File).


Hopefully that makes sense - any advice would be gratefully received.

    Hi,


    Your assumptions are correct, if paid within 28 days of judgement, the entry is removed from your credit file, but don`t expect this to happen automatically, because it won`t, you will need to chase up the creditor and the court.


    The time scale will depend entirely on how busy the courts are, you may be looking at a month or more after your defense has been entered before the case is heard.

    In terms of my case being heard, will I simply receive another letter through the post once the judgement has been made (i.e is it just a case of submitting my defence and then waiting for the judgement to arrive)?

  • Apologies - it is quite a confusing one. However in summary, I received a few letters from a Debt Collection agency approximately 1 year ago. I have written to said agency on 12 occasions since (one per month) asking them to send through proof of the debt. They have never sent this through to me.


    Last month I received the CCJ letter. I therefore responded to the Court and the Agency to advise that I intend to defend the debt, thus providing me with a further 14 days. I have therefore gone back to the Agency 1 last time to ask them to send me proof of the debt, so that I can either admit the debt or defend it.


    If the proof comes through in the next 14 days, then I will decide to either defend it or accept it; depending on the proof that is sent through. I am just trying to look at worst case scenarios here, because whatever happens, I do not want the CCJ on my file. Hence, if it turns out that I am liable, I am just hopeful that nothing will be issued until start of November, because I will be able to pay the balance in full at the end of November; if it comes to it.
