Hi
In new job and have contract that states “in the initial 3 months after employment commencing 3 month notice period for either party, after 3 months this will extend to 6 months for both parties.
Joined 18th June 2018 given notice end of day Thursday 20th September

I think 6 months employer thinks 3 months as notice was given within that week , i.e. notice was given 2 days after the end of the initial 3 months.

Help anyone know the actual answer

Are your days right? You joined 18 June and 2 days later were given notice?

Contract states 6 months notice after 3 month and you have been there 3 months and 2 days. That would indicate that 6 months notice is required. Seems a lot after 3 months but there you are. It's unusual to get somebody complaining that the company wants less notice than expected.

I'm thinking the company is wanting to save themselves 3 months pay. But really I think they owe 6 months and are trying it on.

Timing would indicate a hope to get paid off early.
  • The point is I need the 6 months money they only want to pay 3

I suspect you may well end up having to sue them for it!

Based on what you have posted here you would seem to have a good claim to six months notice (or pay in lieu). Technically notice begins the day after it is issued, there is certainly nothing to say that only whole weeks count. I suspect they have messed up their date calculations and are not trying to wriggle out of an unintended liability!

They could of course make you work the notice and give you some horribly boring job to do for six months!
