Filling out BR Form

Hi,

I earn £1000 a month and my partner earns £3000 all after tax.

Would the OR receiver expect me to pay 33% or 50% of the household bills?

I'm just trying to fill out my SOA on the BR Form.

Also my partner saves £1000 a month. Will this be effected? Do I need to enter this information because the BR form says - Enter what you contribute to; and I don't contribute to this.

    It would help to have more information about the situation in general to check bankruptcy is a suitable option for you. However, generally speaking, when it comes to the budget, if you do a joint budget on the bankruptcy application the Official Receiver (OR) should apply a proportional calculation to the surplus. If only you are going bankrupt then the OR would be assessing how much surplus you have, and if that is in excess of £20 per month they can take 100% of your surplus for up to 3 years under an Income Payment Arrangement (IPA).


    The OR cannot take your partners surplus for your bankruptcy, however, they are also unlikely to permit £1000 savings as an essential living cost on a household budget. But of course, your partner will be able to save what they feel is suitable from their surplus.

    If however, you do a sole budget plan, the OR - without any other information - may assume the split is 50/50, so in your situation, it is better to make them aware you earn a lot less than your partner.

    Don't know if this is a typo or a mistake, but if your partner declined to reveal their income, the OR would assume half the household bills are yours, so you would be less likely to be given an IPA.
