RMA again

A few months ago, after verbal abuse from RMA and their usual rant about only being a phone company, I told them I would only be dealing with them via post. Every week I get one of two letters - please contact us immediately or we have an offer for you. I have written to them asking them to tell me the details of this offer. To date, no details have come through. I have been making regular payments to them.

On Saturday I received a letter from Westminsters Solicitors threatening me with the possibility of court action if I don't pay the full amount by 14 November, and I should contact RMA's pre-litigation department.

The last time I had a similar letter from a different law firm I wrote to them and copied RMA in and no one bothered to respond to me.

Should I be taking this seriously and write back, or just ignore them and treat it as another of their bullying tatics. When you call, they don't even want to discuss arrangements. They don't even acknowledge the fact that you have been making regular payments. You are automatically branded 'criminal' and treated as such.

This would be Westminsters of 1-3 Union Street, Kingston-upon-Thames - the same address as Colletts-CCT also used by RMA i.e. they are one and the same though seperatley registered at the Law Society. RMA's pre-litigation dept is Westminster's who have a branch office at RMA's offices in Preston.
I too have had letters from both and neither ever reply - I requested a copy of my cca from RMA months ago - they have still to produce and know they have breached time rules so they try and bluff/bully by threatening legal action.
I quite enjoy quoting law at them though they, and their "solicitors", are a pain. Hang in there!!
  • Hello.

You may be interested to know that RMA, or what illusive title they choose to use, has been featured in various disguises with Companies House, as follows:

Most of these Companies are either dormant or, in the case of RMA, in Liquidation. So one would be dealing with a Company offering to resolve your financial difficulties, who would appear to be unable to solve their own problems.

A cca is a consumer credit agreement, it's what you signed when you took on credit. If a company can't provide a copy then they have no right to demand payment unless they take you to court, but failure to provide it would be a defense against court action.
Unless I say otherwise 'you' means the general you not you specifically.

Ah thanks... I'm researching a debt for a friend who took on a mobile phone with the promise of a playstation 3... it never turnned up and he cancelled his agreement..... but Westministers solicitors are harrasing him.... I'll do some research to see if I should advise him to ask for a cca.
    Thanks for the quick reply

You can't, they don't cover mobile phones, only loans, credit cards and catalogues.

Thanks... I'll have to try to prove that they didn't send the Playstation by asking for proof of delivery I guess.... Thanks again for your help
