Work shutting down plus holiday pay

My place of work is shutting down, it being a private Care Home, plus while "unofficial" notice has ended for me, I've been doing some overtime shifts. The home is meant to close on Sept 30, though I'm curious if this happens can the owner refuse to pay holidays? How will a union/legal representative get in contact in the owner? Given that after the Sept 30, technically he won't be the owner of the property (to my knowledge).

    Chances are you'll claim from the government fund. The owner might pay up. The date it closes may not be the date the company ceases to exist.
  • I see as the cut off point for payments at work is 24th, to 23rd, so this month's will apparently be paid on either Fri or Mon, with the holiday pay apparently being paid on in October, then at some point the redundancy pay. The thought is that whether its a private company etc, it may prevent people from claiming into his own personal assets if it occurs.

    So Is it worth it asking to separate this month's payment plus holiday pay (paying less tax), or joining my holidays with my upcoming payment?

    I assume this is a limited company, and as such (unless there are very exceptional circumstances) you would not be able to claim his personal assets.


    The rest of your post makes no sense. Considering the payment cut off was 2 days ago I think it's a bit late to be asking for anything. You will be able to claim from the insolvency service eventually. But the boss may end up paying it all anyway. It's difficult to say as the reason for the closure etc is unclear.

    apologies for the unclear nature of my post, but the reason for the closure is because the owner has sold the property. The contractors will be demolishing the premises within the first week of October, if I'm not mistaken, at the very least within October.
