Neighbour erected fence in my garden

Moved house and thought the fence looked out of place between my house and next door .Next door claimed it was in the right position .
I then overheard a conversion between the neighbour and his wife .

She had told me they where thinking of widening their drive to the disputed ground .
He said to her ,we cant as we dont own it for 12 years .
That makes me think they know its not their ground .

How do I go about checking ,and measuring whats mine .The house is mortgaged and I dont have the deeds.

    Appurtenant rights
    An appurtenant right is attached to land and gives the landowner a benefit, for example a right of way over neighbouring land.

    Any Ideas which bit I need .The fees vary from £5 to £51. There is no right of way.

    Have you asked your lender for a copy of the deeds? I don't know what they would charge for that, but it might be a good starting point.

    Does your own solicitor not hold your copy of the deeds? This is usually what happens when you take out a mortgage. When mortgage is paid off the solicitor asks whether you want them to keep holding them or keep them yourself.
    I started out with nothing......And still have most of it left:p

    Deeds are held by the lender, they release them to you when the loan is paid off.

    If you're going to have to pay, you might as well do £17 each for a certified Folio, and certified Folio Map. As far as I know, you need to go to Lanyon Plaza, beside the Waterfront in Belfast, to get these. Since you know your own address, there shouldn't be any additional fees for searching.
    If the land's yours, you've got them. If it's 'disputed' - I would take that as maybe not belonging to anyone - no man's land - that would be different. Maybe your deeds overlap!
