From a high to a low.

So, from the high of having one debt essentially cleared, I have just had a letter before court action on another debt.

Uksearchlimited have been contacting me via email, asking to call, to which I have replied I will not, and now this has dropped on my floor.
What realistically can I do?

Is a debt you owe? When did you last pay towards it? Have you sent a prove it letter? Have you asked for a CCA previously?

  • Yeah it’s definitely one that I owe, but I kept batting them off saying I’ll only talk in writing as opposed to phone. Haven’t sent them anything yet?

When did you last pay towards it? Asking in case it might be statute barred...

  • 2015, so definitely not.
Just that I don’t like talking over phone, much prefer writing, so deferred that payment until they sorted it out to other debts.

If you dont respond to the LBA you will end up with a judgement by default.

This is your chance to make an arrangement, fill in and return the questionnaire, you have 30 days to do so.

You do not have to speak to anyone.

    Hi David

A company has to send you a letter before claim to warn you they are considering starting court action. It's very important that you reply to this within 30 days, and I would recommend doing so by recorded delivery. You will find there are options to make an offer of payment, dispute the debt, ask for more information or ask for time to seek debt advice.

It does not sound like you have grounds to dispute the debt so you may want to consider making an offer of payment. If they agree to this it could avoid them taking court action. You can find a guide to responding to a letter before claim here https://debtcamel.co.uk/letter-before-claim-ccj/

I would also recommend seeking advice from one of the free debt advice agencies on the different options you may have available to deal with your debt situation.

    Best wishes
