Good afternoon all,
I hope everyone is well?
I apologise for this old post been reactivated but I need to ask some questions please.
Today I received a letter from HOIST FINANCE stating I owed around £750, however. IF I pay £120'ish in the next month either as one payment or in three monthly payments they will offer me the 84% discount, I looked for reference to the debt which is on the top right of the page opposite their logo, In my case it was HSBC.
Now the bank gave me a £1000 overdraft and then two weeks later told me they had got it wrong and they had to reduce my overdraft to £500, then the next day it was removed completely so I no longer had an overdraft anymore?
The issue was I had used around £250 of the overdraft, So anyways that was around 15 years ago and I am in a much better financial situation now and want to pay this debt which I dont deny, But I dont like their letter it looks like a scam letter and their (Hoist finance) page layout is very squashed and doesnt look professional.
Is there anyway I can find out about this debt without contacting this hoist finance as I dont want them to have my contact details, I have read about them constantly pestering people and the thing is I suffer/diagnosed with a severe mental health condition (Multi Trauma) and can lose my temper when I feel threatened or not listened to, I wont go into anymore but I have multiple conditions that forced me to retire in my 40s and I get a lot of support for them.
If I paid this debt off I really would get aggressive with Hoist Finance if they kept contacting me its nothing personal just what I suffer with so I need to know if there is a way I can authenticate the debt and if so how I can pay it without going via this company or in a form where minimal contact is made as I want to avoid putting myself into a scenario where it affects my mental health.
Many thanks for any help.0 -
The massive 84% discount is being offered for one simple reason, the debt is statute barred, they know it, you should know it, they are hoping you don`t know it, but now you do lol.
Simply write back stating that -
"In response to your letter received today, no payment or written acknowledgement has been made to this debt in the last 15 years, therefore time has run out to collect on this account, and it is now statute barred, under section five, limitation act, 1980".
yours sincerely.

Just going back to the overdraft situation though, if they removed the overdraft limit that would still leave the outstanding amount in play (and you in an unauthorised overdraft.) You would have needed to pay it off. Unauthorised overdraft charges (particularly 15 years ago) could very quickly escalate. I'm not at all surprised that they got up to £750.1 -

Defaulted accounts only stay on file for a maximum of 6 years, this debt will have dropped off your file many years ago, and nothing can bring it back again once its gone.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
