They must be aware of DMP payments, so if the debt is being paid, why are Lowell threatening legal action?

Well why not speak to Lowell, that makes more sense, i suspect this may be an error, as usually if they are getting paid they are happy, and won`t pursue unnecessary legal action.
Speak to Lowell would be my advice, now today.
Don`t cobble anything together to pay them, that is silly, all a CCJ means is you continue to pay what you are paying now, according to your budget, as that is what a court would order, so nothing is going to change, that is why i suspect its an error on their part, again, speak to them today to sort this out.
Otherwise you MUST complete and return the claim form within 14 days, registering service online gives you 28 days i believe, don`t wait for stepchange, they can`t help you if a claim form has been issued.

I had a bit of a moment today and just want to share it in the hope it will help those just starting to consider a dmp fir their debts.Can only stress that it must not and cannot be rushed.Don't try to cut back on everything all at the same time. It's taken me 9 months to tweak my budget, change mobile and Internet charges, save an emergency fund etc
And in that time life has also changed. I still need to fo a dmp but I've had a pay rise, I've gained a few extra hours work etc.
So I suppose my message is ..stop, take a breath , realise this is a marathon not a sprint. It does not all happen at once, but given patience, time, this forum, there's a way to get back in control.4 -
Hi everyone. Wish I found you sooner!
My story: I have been in a debt spiral for years. Recently a store card reduced my £4K credit limit to £750…£500 BELOW my balance! This account had never been in arrears, always paid above the minimum and by DD. Expletives were said!
I am 41K in debt. All Credit cards and this one store card. Again never missed a payment, always paid on time and often quite above the minimum. But I was using them for daily living and the debt kept growing. My once lovely 18% interest rate pre covid was raised to 38% 2 months ago! How is this supposed to help me?!Without interest I can clear my debt in under 4 years. The store card pushed me into action and 2 days ago I contacted Step Change. Applied for a DMP. Set up the Breathing Space. Then I found this forum…
This is my mess, and I have every intention of paying back all the money but jeez there’s no reward for honesty it seems! I thought I was doing the honest thing and been living on the breadline hating myself for being this financial failure and terrified of assumed future court dates. Now I understand that playing fair gets you a worse deal.So today I have moved my money from my current account and will not be paying my creditors. I now know that I need to save an emergency pot and delay starting a DMP until all debts defaulted. I now know I’m not a failure and to hold my head high and not be scared of the letters to come.I’ve tried for years to be ‘good’ and responsible about my debt whilst caught in a spiral. Time to focus on me.Thank you to everyone here for their wisdom and experiences. 😊3 -
Hi all,
8 months after stopping payments, 9 creditors have defaulted with 2 more in the pipeline. Payments have now been set up with the defaulted accounts.
The only creditor left that is not playing ball is Lendable. Out of interest has anyone managed to get them to default their account recently, and how long did it take?

Lowell have sent the following in relation to a Cca request. I assume this is everything they need and this is now enforceable?

Currently a few months into a self-managed DMP after leaving Stepchange. I have payments set up for the accounts that had already defaulted and I've stopped payments to all other debts while I wait for them to default.I've had a few default notices now and I'm wondering what happens next. Some of them mention court proceedings if payment isn't made by the deadline date given; is this something to worry about or just the standard default notice language? Do they have to let you know the account has defaulted before moving on to court action? I don't want to send DMP proposals out too early and accidentally stop a default but mentions of court action does have me wondering if I should send a proposal just to be safe.Following the deadline of one of the default notices, I've now got a letter from Intrum which is a formal demand, but doesn't mention the account being defaulted. Again, will they actually send me some sort of "This is now in default" letter or do I just need to keep an eye on my credit reports?0

When or even if they do so is up to them, but should be within a reasonable space of time.
