Hi All, I am having a bit of a panic and am looking for some reassurance or advice.
I am just about to start my DMP with Step Change and the first payment will come out on 1st September. I have been struggling with debt for years before admitting I needed help, but managed to never miss a payment up until the end of July this year, which was when I knew I couldn't continue like I was (choosing to pay debt over eating, medical expenses etc) and was in a debt spiral which was impacting all aspects of my life. Which is when I started the process with Step Change and to be honest for the most part I feel a huge sense of relief that life will be more manageable. I also applied for Breathing Space at same time so that is in place until mid September, on the recommendation of Step Change while the plan was set up.
However I am getting a bit panicky because I have received a 'Formal Notice of Default' from one of my creditors saying that if I don't pay them the full amount I am in arrears for (which is one months payment that I can't afford to pay them on top of my DMP payment) they will commence legal action etc. I have two questions -
1) are they allowed to contact me like this when I am in breathing space? I was under the impression that the whole point of breathing space was that I get left alone while I get sorted with the next steps - this particular creditor sent me a letter confirming I was in breathing space when I initially applied so they are definitely aware of the situation.
2) Is this letter just trying to scare me into making an extra payment? I knew to expect some of this when I signed up to my DMP but its just taken me by surprise how threatening this letter is and how far they are escalating it at this stage.
Any advice or reassurance would be appreciated.

Read it again, it will say we "may" commence legal action, and we "may" pass your account to a debt collection agency.
Relax, its a standard default notice, you will get one every time a creditor defaults an account.
All perfectly normal, and a pre-requisite to starting debt management, it must be sent to comply with the consumer credit act, it`s just for information purposes, simply file it away in the recycle bin and don`t worry about it.
Are you certain it`s a default notice, as it seems a tad early for that, are you sure it doesn't say it`s "default sums in arrears" they are chasing ?
Either way its a computer generated letter and will not take into account you entering debt management.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Good Morning, I hope you are all well
My first post here. I set up my DMP early March and everything seems to be going ok so far. I have been receiving correspondence from HSBC for the past few weeks. The first letter being the below:
”To pay the full balance of my overdraft or take it into the agreed amount before the 17h August and if not it will be passed to collections”
I then received another letter from them yesterday advising that “my payment plan (overdraft has now expired and that if the account is not up to date collections will continue and I will receive a pre demand and then a final demand.Receiving those letters has really worried me, I would just like to confirm if this is standard practice even though I am almost 6 months into my DMP? All DMP payments are up to date and none have been missed.
I am also a homeowner on a shared ownership property and I’m just so terrified of the thought of CCJs and charging orders and just anything affecting my home in general.
All essential bills such as mortgage etc are all up to date with no missed payments.
I think it is just some reassurance I need really.
Thank you0 -
Credit report defaults, is it important to
get the duplicates removed? I wasn’t too concerned when PRA bought two of my accounts and reported a default a few months different- however they’ve just purchased my third account and it’s 2 years later so if they file a default now it’ll make a big difference. Am I allowed to ask them to revise the dates or remove altogether or is this just what happens when accounts are sold on? Thanks0 -
