I successfully got Hfx to backdate my default to the start of my DMP, even though by the time I'd decided to fight the late default the account had actually been cleared. It took a bit of to'ing and fro'ing, but persistance paid off. Yep, that's pretty much all that's left if you cannot get them to default. But don't take the first 'no' as the final decision. Escalate your complaint to the highest authority within the organisation - take it to the Managing Director if you have too. Use the ICO guidelines, as has been suggested, and make it clear that if they fail to default you then you may as well stop paying, as that would ultimately end up as a default as part of the process. Hopefully they'll see sense.
I think some companies are ignorant of the fact that an AP marker impacts negatively for a longer period, than a default does.

What do you mean by 'blacklisted'?
Any form of debt solution - be that formal (such as bankruptcy/IVA/DRO etc.) or informal (such as a DMP) will have a negative impact on your credit file. The latter is less likely to affect assets (house) or employment.
Whether a DMP would be right for you depends on an number of things - amount of debt, cash available for debt repayments, current employment status. So its worth doing a bit of research and I suggest having a trawl through the national debtline webpages here https://www.nationaldebtline.org/ as a first port of call.0 -

Update and rubbish news. I have spoken to MBNA who passed by debt to the PRA group in October last year. They will not default for my 2 accounts because I went in an arrangement to pay and didn’t miss any payments then they sold my debt to the PRA group. I feel like I’m now at a dead end and will not have my credit file tainted with this until 20280

I don't know who you spoke to at MBNA, probably just some customer service person - so don't just take what they say as a fait accompli. Escalate your complaint in writing - always best to deal with these matters in writing. Anyone can say whatever they want over the phone, with no recourse. MBNA have a complaints procedure and so send a letter setting out the facts and include the ICO guidelines.
If that gets you nowhere I would then complain to the PRA group and state that unless they default your account and backdate it to October 2018 you will withhold payment until they do.
You do have to get quite bullish these days and be persistent.0 -

The problem they’re saying it I never missed any payments so they have no reason to default me, I made every payment on time they just sold the debt on when they agreed to my payment plan0 -

Just backing up what Suseka97 said and also to reiterate what I said in my previous post on this. This needs to be done in writing, via Royal Mail. It needs to be done as an official complaint, so that you can escalate to the ICO, should MBNA not uphold your complaint. And don't forget to quote the old ICO guidance from post #4, in the thread I linked to in my last post.

The principal is that an Arrangement to Pay should be used a temporary solution and that a borrower who has a DMP should not be worse off than someone who made no attempt to pay via an arrangement to pay.
I did do it in writing and they phoned me back about it, it was a complaint manager. So they can still default me even though I didn’t miss any payments and they sold my debt on?0
