I did ask on all about debt they said it was unenforceable as no signature anywhere on credit agreement terms and conditions or SOA. I was worried about this as have read signature was not required debt from 2009.
They sent a copy at the bottom of the page it states paragon file store online .com 12/04/17
I did make a complaint to IDEM and they said it was correct due to reduced payments I then went to ombudsman who sided with them,0 -
Hi all, it has been ages since I posted on here and have come back for some advice please.
Been on a DMP with SC for a while now and my initial debt of 48,000 is down to 24,000. So good news there and I haven’t lost sleep over a debt for quite a while now ��
I want to go self managed. I have all the accurate totals owed from SC site.
I have sent off CCA requests. Out of the 8 debts, 5 (the largest) have no CCA - they are old.
I’m getting myself into a pickle with my next move. I have looked at the NEDCAB site and am a bit confused .....
Do I write to the creditors and say I am setting up self managed and will be back in touch within a set timeframe? Then contact them with I&E and proposed £1 payment schedule at that time? Payment via standing order?
Do I include the non enforceable debts in this self managed DMP with the same process of holding letter then I&E?
I just feel that I need to have a clear plan in my head and it is jumbled at the moment. TIA for any expert advice ( of which there is loads on here from previous experience)0 -

What is the purpose of the £1 payment?
Do I include the non enforceable debts in this self managed DMP with the same process of holding letter then I&E?You appear and please correct me if i'm not understanding,wanting to go self managed.So in affect you are transferring the DMP from step change to your own.So Write to the creditors to inform them of this and cancel with SC.Include your revised I&E sheet based on ALL Debt included in your new DMP.Set up new S.O for the start date or next payment date ,if you are requesting a break for some emergency.Now you have to decide what you are doing about the ones with no CCA documentation - continue to pay them,make a F&F offer,inform them you are putting their payments on hold (they should have already told you collection activity is on hold whilst they seek the requested documentation).

All please note, a copy credit agreement does not require a signature to be valid, there is no requirement for a signature on this document to make it enforceable, an unsigned copy is still valid.

Hi Everyone.
Will try keep this as short as possible. I've not posted before and was hoping for some support and encouragement to help me with my current debt issues!
I am currently on a DMP with Step Change 5 Creditors, 4 Credit Cards 1 overdraft totalling £14,600 :mad:
I started the plan in January after my husband of 10 years left me with three children. The debt is all in my name, he took redundancy from work 5 years ago and has only recently got back into employment, I was paying the household bills and costs on the credit cards as well as transferring cash to pay the mortgage- hence the build up of debt! I work 30 hours a week.
I could not continue to the minimum payments when he left and contacted Stepchange.
All the accounts have defaulted, and I am paying £200 a month to Stepchange which is split between my creditors.
I am suffering with quite serious stress and anxiety, I am on medication, but just can't control the fear of creditors taking me to court or me having the house reposessed. (this happened to me as a child and is where my anxiety comes from)
I have not missed any mortgage payments and my priority debts are all upto date. I've started saving any spare money I have to try and put towards clearing the debts and I wondered if there was anything more I could/should be doing to stop my creditors taking any further action?
Some of my debts, Mint RBOS were opened in 2003/4 time would it be worth asking for CCA (its been sold to Westcot) Is it likey the creditors will start applying interest and charges?
This my seperation and this situation has honestly broken me, I'd be really greatful to hear from people who are in the same boat/come through the other side for some hope of a way forward

I’ve just finished a DMP with Stepchange after 4 years. I don’t know anything about CCA’s and there are much better people than me to advise on that score on this site.
I’m writing to say that not once in those four years did my creditors contact me or threaten further action. I contacted them for up-to-date balances a couple of times and all were perfectly pleasant with me on the telephone. They never pressured me to increase payments and all checked they remained affordable and that priority bills were still being paid.
I hoe this helps reassure you a little. Well done for taking the important first steps and good luck with everything.

Thanks so much for your reply, it is great to hear from someone with a good experience, could I ask, did you have a mortgage whilst on your DMP? I have some equity in my house, but not enough to ever buy again if it was taken from me to pay my debts.
I’m probably just overthinking everything. I really want to pay everything off as soon as I can.

I have been informed by CABOT and PRA that the debts are not enforceable in response to my CCA requests.0 -
You don't need to pay the unenforcable debts going forward unless they produce the agreement requested so you can write and say you are concentrating on your enforceable debts.
You don't mention any change in circumstances or what you have been paying but I would be cautious about changing your monthly payments drastically without supporting evidence.What i'm trying to say is make sure you're I&E shows you can only afford this £1.If you've been paying back at a reasonable rate to get where you are now how are you going to explain only paying £1 all of a sudden?Bear in mind these remaining debts are enforcable.

I don’t have a mortgage but I’ve read about others on here who have and haven’t had any issues. From what I’ve seen if you have an arrangement ie Stepchange and you stick with it they are happy. I can understand your anxiety on that score though.
I hope someone who has completed a DMP with a mortgage can offer reassurance to you.
