    Hi all. Just a question on phone bill debts. If I add this to a dmp plan with StepChange will the phone company cancel my phone, guessing they will.
    And allso I have an overdraft but I have a good repayment plan with my bank and I don’t want to add that to my dmp. Does this mean I don’t have to change bank accounts

    I can't answer your query regarding your phone contract - is this a landline or mobile? But I imagine its a possibility.

    As to the overdraft - if you are intending to use SC's services then I think you'll find they'll expect you to add the overdraft into the plan. Not sure how you would 'hide' that from your I&E if you didn't want to do so. I guess my question is why would you want to - other than to save yourself the hassle of changing bank accounts?

    Thank you for your replies. Has anyone had any companies that have pursued further legal action (ie bailiffs/court orders)? My DMP is due to start 1st August, I have a share in an asset that is currently in the process of being sold but as it’s a French apartment I’m not sure how long that will take to be processed with regards to French property laws. Really hoping the sale goes through before anything is triggered as the money will help dramatically.
    Starting my life over August 2019. Total debt: £18532 :eek:
    March 2020: £8858 left to go

    This forum puts my mind at ease. Yes was just convenience really so I think I’ll swap the banks.
    I sent out my letters to ask my creditors to put my account on hold. I’ve had most back now and most are on board and agreed to freeze my account. But I’ve had two back who have said they are unable to do this. Any advice on where to go from here with them ?

    You're getting a little ahead of yourself here. You reallly don't need to be worrying about court / bailiff action at this point in the process. Just continue through with setting up your DMP and all will be well. The only thing that could potentially happen is that your creditor/s would hand your debt over to a collection agency to act as a 3rd party on their behalf, or might sell your debt on to a debt collector. Neither of these are the same as bailiffs - a completely different animail :D

    Unfortunately not all companies will freeze interest or put your account on hold - there is no legal requirement for them to do so. This is where going through one of the debt charities puts you at a disadvantage - because they will simply continue to pay whatever amount has been agreed regardless of whether the creditor stops interest or not. They won't advocate on your behalf. Give it a few months and if they continue to charge interest, then raise a formal complaint with the creditor/s -sometimes that'll work, but when it comes to catalogue debts (Very and the like) they seem to be quite stubborn on that front.

    :D Apologies I’m always catastrophizing, I’ve watched too many channel 5 shows to make me paranoid. I think also because I haven’t been in control for a long time, that this is amplified and magnified.

    The channel 5 boys are high court enforcement agents.

    Consumer credit act debts are dealt with at county court level, they cannot be upgraded to the high court.

    County court bailiffs can only act on a warrant from a court after a county court judgement has been issued against you, and you have failed to pay it.

    Each enforcement level costs the creditors more money, a bailiff can be stopped in their tracks just by locking the door, and refusing them entry, you are a million miles away from any of this at present, always better to do your research than to have sleepless nights.

    I’m just about to enter a DMP and firstly, thank you for al the wise words on this page. It is giving me the confidence and support I was getting no where else and consequently leading me to awful panic attacks all the time. Now I understand how things work and it’s going to be tough, but thanks to you all, I can do it.
    My question is, I have a joint account with my dad who is 76. He doesn’t care about his credit rating and he doesn’t really want to lose the flexibility the joint account gives him for paying for care etc Can I keep this hsbc bank account open as a JA or do I need to close this? I have opened up a sole co-op basic account. My debt lies with myself and my husband.

    Hi Mike,
    I didn't change accounts, I waited until I was paid before i sent my statement to SC they accepted that the overdraft was cleared then I carried on using it.
