Payroll department refusing to correct my pay

Hi,

I am currently in a position of being incorrectly paid by my NHS payroll department. I have recently been on sick leave due to fracturing my shoulder and having an operation after having an accident. I returned to work end of July and completed all paperwork, my department said they filed this with payroll. Payroll say they didn't receive this until 14th August. I received only half pay plus SSP. I should have received full pay and no SSP. Payroll are refusing to correct this until September pay date, which is frustrating as all my bills came out 1st September. I made this and my financial position very clear to payroll and all they could offer me was some amended pay on the 17th September, which is obviously much too late for my bills and mortgage. My question is, are payroll obliged to help me sooner than what they claim as I was not at fault, but someone in admin failed to communicate with payroll? They have declined to offer me a payment in advance as they were not at fault, but as it was not I that made an error should they be obliged to assist?

    I think you should probably be talking to whoever failed to advise payroll correctly and getting them to sort out the mess. There is no obligation to assist you but if the fault was entirely outside your control, it would be reasonable to expect your employer to make good any charges (e.g. bank charges) you incur as a direct consequence of their error.

    Also remember that the only way to enforce such a claim would be via court; which would take longer than the 17th sept anyway ( and not do much good for employee relations)
