New plan wanted as CCJ has ended

Hi all,

I am looking for some help. I have had a payment plan with the Marston Group for the last couple of years after a CCJ was awarded and the sent bailiffs round. The CCJ has now come off my file as it is after 6 years and the Marston Group have sent me a letter to contact them to set up a payment plan or the will start court proceedings. I wasn't aware that the payment plan had stopped.

Does anyone know if this is normal practice after a CCJ has finished?

    Hi,

    CCJ’s do not “end”, or become statute barred.

    Just because it’s fallen off your file makes no difference at all, the judgement is still live, and will be until satisfied.

    They cannot take you to court again for the same debt, but they can further enforce the original judgement.

    A ccj isn't 'finished' until you have paid it off.

    Why did your payments stop? How were you making them? Standing Order?

    It seems unusual for Marstons to be acting on a ccj - what was the debt originally?

    I also don't understand the threat. The court has already ruled on tis. The normal threat would be to send the bailiffs back.

    Thank you for this, I didn't think it did so I just presumed I would keep paying them what I have been, but they want a whole new plan set up.

    You are only liable to pay the judgement amount originally set by the court, no more, no less, if they want more money off you, they have to go back to court and get a judges say so.

  • The debt was for unpaid uni fees. The CCJ had 'come off my file this month but I am still making payments of £70 per month via card transaction (automatic on the 2nd of each month) with the last one going throufh on the 2nd of September

    It's all very strange
  • Ah have just re read the letter and it states that if a payment plan is not agreed then they will send bailiffs round as it is a high court fit

    Just think it's strange that I wasn't told the payment plan I had had stopped

    Continue paying the £70

    Do not allow the bailiffs entry to your property. They are not allowed to force entry, regardless of what they say, unless they have previously been in and accessed your goods.

    HCEOs can be bullies, and Marstons have form on this. The story makes sense now.

    If this is part of a bigger debt problem, you do need to take advice, and National Debtline is a good place to start.
